As you were told in post # 5, NEWBIES is the place to go, post # 2, where all your questions will be answered. There are about 17 different defence examples. Outcome will depend upon a judge believing your version of why you did not defend the original claim, a solid six-point draft order (which presumably you have filed since you have a court date) plus a robust defence and witness statement of the original alleged incident.0

Hiya. I'm looking through the Newbies Thread now and learning a lot, really appreciate the advice.
I haven't seen a defence for "Parked without clearly displaying a valid PCM UK Ltd permit (at time of enforcement)"
It says on all 5 tickets, about there being a notice to driver being previously affixed to the vehicle. I've seen all 5 photos previously and in only one of them was there a ticket - which was obviously placed for the photo because it wasn't there in the morning when I left for work.
The times on these tickets are mad,
4.39am
4.49am
3.57am
4.50am
5.56am
I didn't defend the original claim for the first 5 because all letters and tickets were sent to an old address. Judge should hopefully believe me, PCM will have proof all correspondence went through to a different address. They've sent me copies of the latest 5 tickets which have all now gone through to Trace Recovery and are about to be passed over to Gladstones.
I've just sent a SAR to PCM UK at this E-mail address, 'info@pcm-uk.co.uk' requesting all data, photos and all evidence they will rely on for all 10 tickets.
What do i do next? What's this solid six-point draft order? I've not submitted this, nor do I have a solid defence or witness statement. I presume all of this is on the Newbies thread?0 -
That is the correct e-mail address for the DPO at PCM. The six-point draft order is what you should have included with the set-aside form N244. Yes, all advice is contained within the NEWBIE thread PLUS you can search for other posters who have gone through the set-aside process by using Search This Forum on the first page of the forum, Advanced, set-aside six-point draft order as your search term and change the radio button from threads to posts.0

This could end up costing thousands all for sinlmy parking in my own space allocated to the property I was residing in. It's disgusting.
But it was not your space, it was for the tenant. You need her on side, as, AFAICS, without her support you will have a struggle. You never know how far you can go until you go too far.0 -
Brilliant, thanks Le_Kirk, can I type this 6 point draft order up and take it with me? I also need to prepare a Witness Statement and a defence too? Correct?
I've sent a SAR and in what order do I need to complete everything now to be prepared for court? I still have these 5 outstanding ones with PCM too - do I just wait for a LBC0 -
No, you are meant to submit the draft order and WS and £255 fee with the N244.
Please just read lots of recent set aside threads, by doing that easy search.
I answered that last night, above.I still have these 5 outstanding ones with PCM too - do I just wait for a LBCPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Apologies Coup. I've frazzled my brain by reading so much. Yes, I've re-read your response. I'll wait for Gladstones then.
Ok so I haven't done a draft order or a witness statement? I found this site after I'd sent the N244 and paid the £255. Do I need to do one for the set-aside? If so, do I take them with me or E-mail them to someone?
Basically I need a step by step instruction on what to do now, leading upto my set-aside court date, while I'm there and then an idea of what happens? I was under the impression it all gets sorted on this particular date, but this is just the set-aside thing isn't it? I'll have to go back afterwards to defend the tickets?0 -
Which is what you will find when you search and read the other set aside threads that show you, step by step, what happens and what a Judge wants to hear, and how everyone always wins.Basically I need a step by step instruction on what to do now, leading upto my set-aside court date, while I'm there and then an idea of what happens?
Please, please use the WONDERFUL search facility that cracks this forum open so you see more than the tip of the iceberg.
Why not wait for the court directions/hearing date and the Judge may well order that you provide x y z before the hearing, and you can then send in your WS and draft order (and maybe a defence if the Judge wants it).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi
So today I've received letters from Trace Recovery saying they're going to instruct their client to appoint a solicitor to proceed with court action against me unless I pay £160 x 5 for each ticket. I have 14 days to pay.
What do I do now?
Also I've received a huge wad of stuff from PCM which is my SAR.
What do I need to do with response to Trace now instructing Gladstones to commence legal proceedings and what do I need to do for my defence for my set aside hearing on August 21st?
Kind regards0 -
As always ignore debt collectors
Regards your set aside hearing, see coupon-Mads reply to you on that same question in post #29 just above0
