Did you do the AOS? You only have the extended period to submit a defence if you did.0
-
If you did the Acknowledgement of Service by Tuesday 30th July, then your target date is correct. Please confirm that you did the AoS before last Tuesday.Date of Issue was 11th July, from Northampton.
so the defence needs to be in on 13th August, correct?
If you did the AoS in a timely manner, you have until 4pm on Tuesday 13th August 2019 to file your Defence.
That's just a week away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
When you are happy with the content, your Defence should be filed via email as suggested here:-
Print your Defence.
- Sign it and date it.
- Scan the signed document back in and save it as a pdf.
- Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
- Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
- Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
- Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
- Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
0 - Sign it and date it.

In addition, is there any further argument regarding passing through the area on return from an area not in their management?0 -
Please can someone give me a link to the judgement where the judge said that stopping isn't parking. I km struggling to find it. Should i include it in the defence or wait until the bundle?0

That was a parking eye fistral beach case about 4 or 5 years ago and blogged on parking pranksters website
If the was a transcript it would be hosted there too
The thread from start to finish was on here too, with various advice and links
The defendant is also a Facebook member of an action group in Newquay that fights those car park PCN,s although it's been Smart and now Initial parking since then, same car park, same issues
Start by looking at pranksters blogs around that time, or try a Google search with suitable search words, plus use the forum Search box here with suitable search words0 -
Thank you @RedX.
I kill hunt for that. I also found Jopson vs Homeguard 2016, which has a transcript that is findable on goog lik e (paras 20 and 21 are most uaeful).0 -
I have added quotes from the transcript I have found. Should i not do that but wait until the Wtness Statement to include it there?0

Help.
Small claims directions questionnaire.
1. Is the witness question (how many witnesses will give evidence at the hearing?) just for witnesses coming to speak, or any written ststements that will be included?
2. Do i photocopy the questionnaire and send it to the claimant too?0 -

Have you checked the NEWBIES FAQ sticky, post #2 which covers all such questions, and provides the answers? The sticky was written with the intended aim of relieving the pressure on the tiny number of regulars of having to answer the same questions all the time.
Not sure it's working! :cool:Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

1) how many will trn up
Any witness statement NOT supported by the acutal witness in court can be dismissed bythe court, counted merely as hearsay, or accepted, so of course there is a risk there
2) The cover sheet instructs you to make sure all parties receives it, and the newbies thread reiterates that.0
