    FEE SCHEDULE
    Any further correspondence to StillSkints son at Xxxxxxx will constitute the agreement of your company or any agent to the following Fee Schedule:

    1.£30.00 (THIRTY POUNDS STERLING) per letter received from BW Legal to StillSkints son, nunc pro tunc,

    2.£50.00 (FIFTY POUNDS STERLING) per letter being returned to BW Legal by StillSkint, nunc pro tunc,

    3.£150.00 (ONE HUNDRED AND FIFTY POUNDS STERLING) per hour or portion thereof, of the Authorised Representative’s time to deal with the above matter, nunc pro tunc,

    All fees are payable in Twenty One (21) days of date of invoice is received, as evidenced by recorded delivery tracking number
  • Two weeks after sending the above I had a letter a day for my son four days running!

    Surely this isn’t a suggestion of a typo? I don’t think it can be, as a firm of solicitors they would be using due diligence whilst composing letters on behalf of clients? To make such a schoolboy error would suggest that BW Legal are incompetent surely?

  • Ok so got my son to email another SAR so we can see exactly the volume of letters from BWL.

    I have the SAR stuff until June 2019 clearly containing a letter from me in May 2019 telling them he no longer lives here and also that it is not an appropriate address for service. So they can’t say they didn’t know earlier than this month.

    Evidence is building nicely for my claim if they don’t pay my agreed invoice. I also have my own record of mail received so will be able to see if the SAR is incomplete.

    I am sure Beamerguy will agree with me that BWL are a top company agreeing on behalf of their client that I deserve my reasonable fees for the sheer inconvenience and stress caused by having to deal with and return their excessive amounts of mail to somebody who doesn’t even live here.

    We did ask for my sons case to be heard in Wollagong (or similar) court house as his nearest court, unfortunately it was sent to Cornwall instead and then we heard no more.

    Please find enclosed two invoices, as agreed by BW Legal.

    Invoice 01 is overdue; however as a gesture of good will in light of your agreement to accept the invoices, I shall restart the 21 days requirement for payment for both invoices – please remit your payment by 9th October 2019 to avoid extra administration charges.

    These invoices are my fees for handling mail addressed to my son at my address, despite many communications with BW Legal advising them that he does not reside here, culminating in a cease and desist letter with my fees schedule for handling any further mail (letter 1 – highlighted area). In response to requests for my fees, BW Legal have said that their client (you) accept my invoices (letter 2 – highlighted area), therefore I am seeking remittance directly from you as their client.

    I shall await your remittance, as per your legal representation’s agreement on your behalf to accept my invoices.

    Please note – failure to pay these agreed invoices in a timely manner could result in legal action. If you are having difficulty paying, please contact me to arrange an affordable payment plan.

    No, send a formal Letter of Claim, and follow the process as now outlined by the Pre-Action Protocol for Debt Claims, as below.

    Then issue a MCOL claim if no positive (or any) response, then they have to respond, or risk a judgment in default and a potential CCJ.
