    Oddly enough my son’s directions questionnaire came today, his defence was submitted about three weeks after my partner’s. He is going to download the pdf blank form, fill it in, scan it and email when he is next somewhere he can access an Internet cafe. Perhaps they think they will have an easy win against him even though it’s the same defence - no mention of a penalty or what amount on the signage relating to visitor bays.

    It is neater to do it in the other order.

    Fill in the form online and then print the completed form.

    Then sign, scan and email to the email address in post #9 above.

    Do not forget to send a copy to the Claimant - address on the Claim Form.

    Notwithstanding the advice given by KeithP, do not miss the deadline by waiting until he is at an Internet cafe.

    Last communication was to say claim had been transferred to our local court.

    After my partner pursuing where BW got his email address from we were informed that it had been obtained from GBG UK and was apparently “consented information”, on requesting an SAR from GBG UK they have responded that they have never held data on my partner and that they have not given any information to BW Legal. BW had also tried to phone my partner so had also obtained his phone number. This information is not on the DVLA SAR info, and has never been given to Armtrac/BW Legal by my partner. Not only have BW Legal blatantly lied about GBG UK providing the data, they still have not disclosed where they obtained it.

    My partner is going to start a complaint to the ICO, it may seem like a small issue that they have managed to get these personal details, as attempts to communicate were ignored anyway as he doesn’t owe them any money, but it is not right that these “legal” firms think they can obtain and use the private data without permission. They do not have a legitimate interest - a parking charge is a speculative invoice and a civil matter.

    Also, another resident of the building spoke to me about parking and recognised me from this thread - Hello neighbour!! And they said that they have seen the Armtrac operative bounce a vehicle so that the pass dropped out of sight and then issued a ticket, and also that one of the operatives is having the police pursue an ASBO for them due to their behaviour towards a female who lives here. Additionally, another resident has told me that Armtrac have no formal contract with the current management company.

    I know this forum is monitored by these companies and I sincerely hope they recognise me also - nothing but the truth is being said, and nothing that won’t be in my partner’s witness statement for court.
  • Had a response from BW offering a “last chance” to settle before it goes to court.

    Armtrac do not intend to invoke POFA, however wish to pursue keeper liability.

    Armtrac will not disclose a contract with the landowner due to legal privilege - probably because one does not exist.

    They have incorrectly quoted the signage.

    Rest of it pretty bog standard, which can easily be responded to.

    Any further advice for responding to the above?

    I’m not sure, presumably they think they are above the law?

    It was laughable they quoted the signage but what they quoted wasn’t actually on the signage.

    We now have a formal complaint with the ICO regarding their obtaining, using and storing personal data. Lying about where they obtained the data - didn’t expect us to do an SAR to where they said they had got it from I guess.

    Funnily enough today received the date for small claims court - I am familiar enough with the small claims court to know that BW now have to provide a full witness statement and also pay their fees.

    Nothing for my son, received a lettter from the court that they had until 27th to provide a reply to the defence - nothing so far.

    This week have had a letter a day arrive for my son from BW legal - sent back unopened. Nothing from court relating to his “invoice”.
