  • Heard no more about my sons claim - heard it was transferred to local court and then nothing else.

    Re the invoices - I claimed them as my fees for handling my sons mail after I sent a cease and desist letter. I will keep going now they have agreed them - obviously I now have to issue an overdue invoice, then a pay up in 14 days otherwise I will claim. I am no stranger to being a claimant to small claims so happy to put the boot on the other foot and see how they like it.

    After all, they may have discontinued the claim but what abut the hours of LIP work done, photocopying, printing, postage, let alone the extreme stress on us as hardworking law abiding members of the public being treated as if we are some sort of criminals?

    Glad to hear it, and what's to lose? Press ahead for the sake of a £25 court fee! Let us know what gets offered in the end to settle it, a fascinating approach and hilarious that they replied accepting the invoices.

  • They have definitely said they accept my invoices, I can’t believe they have been so reasonable and I shall look forward to receiving their remittance.

    Ah, so their CLIENT accepts the invoices. So, now put pressure on the CLIENT to pay your invoices. They will get a nasty surprise when they see your LBC and you should attach BW Legal's explicitly stated agreement letter as evidence!

  • I have got two invoices of £235 so £470 in total, one is overdue today. I will probably have to add some admin and postage fees on soon if I do not receive their remittance in a timely manner.

    I will await a response to my letter above, so I should start sending invoices to both BW Legal and Armtrac? That will double my expenses and admin charges.

    Send a 'final pre-action offer for them to settle' to Armtrac (round the sum down by a quid or two, as an early bird offer!) with BW Legal's letter attached.

    Warn them that if it not paid within 21 days, given their solicitor's implicit agreement on behalf of their client to the invoices, you will proceed against both companies as jointly and severally liable for your time wasted on this meritless case. Having been fairly warned, they also need to take note that this will double the future expenses and admin charges.

    And that interest will be charged from October for the overdue invoices, at the court rate of 8% p.a.

    Send NOTHING to BW Legal yet. Let this hit the fan at Armtrac Towers first!
