  • Thanks CM, yes that's exactly what I had in mind. I will look into this. I suspect the courts may not have centralised figures, so worst case it might be something which needs to be requested from each court one at a time, which would of course be a headache, but perhaps worth it especially if doing by email.

    491 emails to be precise.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

However, you MIGHT be able to ask that question of the Ministry for Justice and get an answer...they should be able to interrogate the claims filed by BW Legal (as an MP did here << click!) then tell you how many of those claims in the past 12 months:

    (a) were defended and allocated to local courts for Directions, and then
    (b) were ended by a NOTICE OF DISCONTINUANCE without a hearing.

You can't use MP's questions of course but you can use WHATDOTHEYKNOW for an FOI.

YES a FOI request to the Ministry of Justice may well alert the government as to what is going on
  • only 491, should be a dodde! I have a few programs and resources, I could probably 'scrape' all those emails, into a comma separated list quite easily, and give that list to anyone on here interested in submitting the same. That might get noticed. HA HA HA.

You misunderstand ... the MoJ would have to send those emails. :)

    Why is that?

Why can't Didger send a FOIR to each of the county courts asking that question?

Because there is only one County Court in England & Wales, with various hearing centres around the country.

HMCTS is an agency of the Ministry of Justice, and any FOI request would end up with them, to be answered (or not) centrally.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

I costs nothing to ask the MOJ with a FOI request, how they deal with it is up to them

With such questions, it may well provoke them to wonder why the questions are being asked
  • I see the point being made, although I don't think I misunderstood. In a FOIA request, I can ask every court in the country if I want, each and separately, or I can do as suggested and ask the central body to gather that information for me in a FOIA request for all that data. That's my understanding anyway. I was contemplating doing it the laborious way, as emails are free. But if the other way works then yes that makes sense too and perhaps even more so, as the central authority (MoJ) might just spot how much abuse is going on at a national level, if 'someone' causes them to take a butchers :)

No, it doesn't work like that. All the requests to the 175-odd courts would simply be referred back to the MoJ, and they would then say that it would take more than 3.5 days to collate the information, and refuse the request for that reason.

I have no idea why you would want to do that anyway, appearing to be on some sort of 'crusade' will go down like a cup of cold vomit with the Judge hearing your case, who will only be concerned with the facts of that case, and not with what may or may not have happened elsewhere.

Your thread suggests that you are massively over-thinking this.
