    didgeridoooo ..... may I say this ...... this is not a movie, we know how flawed BWLegal are and so do the courts. The judge is going to make his/her mind up on just a couple of points, the rest will be ignored.

  • Hi, I know this post is an old one, but any advice would.be welcome.
    Firstly I purchased a car a year ago.and gave my new address to car dealer who chose to.write my old address on V5. Yes I know I should have checked but I didn't? So a year on when knowing I needed to renew my tax i discovered this error. Anyway after a finally sorted this, i got a letter for a parking fine from BWlegal which had occurred 6 months before for £240. This was the first time i was aware of this as the previous letter went to my old address. But to make matters worse, i definitely did pay for a 5 hour ticket and left the car park before that 5 hours ran out. I have appealed on their standard form Nd they have said I did not purchase a ticket and simply sent a picture of my car entering and exiting the car park. The only thing I can think of is that maybe I could of accidentally got a digit wrong. But I know my reg so if I have it would be a minor mistake. Is there anyway I contest this. Surely they would have a record of a number plate entered that did not come into the car park. Any advice would be much appreciated.

    Would you please start a new thread of your own as trying to deal with other cases on this thread over-complicates everything, and the thread is complicated enough in its own right!

    Letter arrived: Notice of Discontinuance.

    I am pleased in one aspect, to relieve people of any more pages to this thread. But in all other ways I am absolutely sick to the stomach. I have incurred huge losses in time and quite a bit of money in costs, printing, folders purchased, a lot of postage, journeys back to the car park and to post docs etc...

    Not sure whether I can interpret this as confidence in my WS/Defence, or whether they just couldn't find anyone to 'advocate' for them in Truro. One thing I can say is I am absolutely LIVID. The very same day on which they emailed me a £100 settlement offer (letter the day before offering same), they POSTED OUT a letter of discontinuance. This is outrageous, taking me to the wire with (I assume) no intention of proceeding. I have £1500 LiP costs claimed in my schedule and now no chance of getting any of that back, not even the postage costs for Pete's sake. I am now highly motivated to take the fight back to them in any way I can. So any advice on how best to do that (if I can at all) would be very welcome.

    Thanks everyone. I got another letter of claim from BWL for another case yesterday so my PCN travails are far from over, but at least everyone can take a deep breath knowing this thread is coming to a close and no future ones will be a fraction of the size. Again, THANK YOU to all (too many to name) who helped guide me here.

    Very pleased for you. They probably discontinued because their case was nonsensical.

    Doubtful you would have achieved £1500 in costs

    Yes, it's a pigs ear but you won, they chickened out. Given the grief they caused you both, your next step is the SRA and The Rt Hon Robert Buckland QC MP, Lord Chancellor and Secretary of State for Justice. with a copy to Boris.
    Plus lobby your MP to bring this matter up in the house

    So you have another claim ? I think everyone on here would suggest you start a new thread for a new case as this thread is now so big it will confuse

    Do you have a claim for a DPA breach, by any chance?
    Theyve been processing it for this long clealry with no cause to do so - otherwise they woul dhave gone to a hearing.

    Thanks Bmer - Sure, I wasn't expecting to achieve those costs, but I had a chance, and more importantly I should definitely have got my postage and stuff which is money we badly need back.

    I will be doing all those things you mentioned, but I thought there must be a way to counter-sue for my costs, surely they can't just bring me to the brink and then pull the rug so I can't claim costs when I kick their ar5es? I will research it elsewhere, but if anyone has any tips or legal terminology to set my Googling off on the right foot, I would be grateful. I may ring the court in case they have any ideas. Talk about speculative invoicing, this is speculative court abuse. If the victim doesn't pay off, pull out at the last minute. There must be a way to fight back, surely?

    I like your thinking. Trouble is they are claiming against me on various other PCNs so they could still argue they have good reason to process my PD. I will give that some thought though.

    The problem is, it's a small claims court and they can walk in and out as if it's a public convenience. When you complain the those mentioned, highlight the fact that they wasted the courts time, from Northampton where the claim was issued and the transfer of the case to Truro. . Their nonsense has cost the county court system as well.

    You could invoice them for your costs and follow it up with a letter before claim and for £25 (depending on amount) but whether they respond is a different thing

    EXPOSE THEM, that will cost them a lot money just trying to defend their stupid actions. They must be stopped and they will be

    In the meantime, you have a new claim, start a new thread and tell us what they are claiming as no doubt they have added their abuse of £60, not just you they are abusing but the courts as well
