  • Actually when re-reading that Order, I would not write to the court (no need). 
    Just send BW Legal the email I wrote, and await further court Directions in the Summer.

  • BWL's WS just landed. They have said they won't be attending any hearing and an advocate will represent them. I'll post the WS up later if anyone is interested, but they have provided a link to this thread https://forums.moneysavingexpert.com/discussion/comment/76055192~Comment, saying that I have copied and pasted things I do not understand into my WS and if I was cross examined I won't be able to answer sufficiently!

    Standard stuff , nothing new , I am sure their ws is the same and full of copy and paste rubbish , plus you cannot cross examine b w legal because they will send a gun for hire , which is typical

    Just shows how desperate the industry are.

    Judges pay no regard to forum posts and in fact you can paint this as intimidating and unreasonable conduct, designed to patronise and to act in terrorem of a Defendant, who they hope will worry that they've done something wrong.

    In the telephone hearing I took part in last week, the Judge said before adjourning the case to a later face to face hearing (to ''see the whites of your eyes'' he said to the parking firm Director!) that the answer to a parking firm's allegation that a person is using an internet template is ''so what?''

  • Got my hearing next week. Reading the accounts of successful appeals has calmed me down a little but I am still a nervous wreck! I've provided the court and claimant with electronic copies of my documents and I am planning on taking hard copies to the hearing. Do I need to provide the court and claimant with a hard copy too? I'm thinking due to COVID might be better if everyone printed their own! Is there anything else I need to take to the hearing aside from what I have already sent electronically, i.e. WS, defence, photographs etc?

    I've not checked - you should do so; check what the court has ordered to be done ... have they stated that electronic filing of documents is OK?

    Take a hard copy for the Judge, you don't want him/her to be without a full copy.  Some courts will only print a finite number of pages and if you've exceeded that number, you're 'chopped off' at that point. The PPC can print their own if they've already had it by email. 
    Is there anything else I need to take to the hearing aside from what I have already sent electronically, i.e. WS, defence, photographs etc?
    Have you already submitted your Summary Costs Assessment, including a copy to the Claimant?  If not, do that now. If you're claiming loss of earnings/leave, take copies of recent pay slips to prove earnings level. You do not send them with the SCA, the PPC has no business viewing them. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    HAve you got a FULL copy of the landholder contract?
    Please post the complete contract, exactly as its been given to you, for us to look at. Do not redact anything on there unless somehow it identifies YOU. Nothing else.

    You said in May that you had received their WS and were going to post it, but I don't see it.
    As above, we need to see the whole WS, exhibits, and contract. Only redact your personal data, nothing else.
