This isn't true and needs removing:
Owing to the lack of adequate signage, no contract can be formed with the landowner and all tickets are issued illegally.

And the statement of truth changed last week to a longer version - Google & read the CPRs.

Removed the incorrect part and also added this to the SOT: I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth.
  • Ok so I've read through some more threads and decided to paste all the 'extra' stuff about abuse of process etc into a supplementary WS. Not sure if I need to include the bit about landowner authority. BW's response to my defence (which does contain the part about landowner authority) states that their client has the relevant authority and they will provide evidence of the same at the hearing if required. Pretty sure this is another robo para but happy to be corrected. For the photographs that I want to include as evidence, can I make a cover sheet with a table of the reference numbers and a short description of what it is, e.g. Page 1 - Exhibit AB1 - photo of car park.
Also, is there any way of emailing all this to the court or does it have to be posted?

All of what you said sounds good.  DO challenge landowner authority and (if relevant) proof of the site boundary.

  • Do you think it is worth sending the letter beamerguy proposed about BW and their abuse of process nearing fraud, following the Southampton judgement against them?

Regarding my appeal, should I make a folder or will a bunch of documents stapled together be ok? Do I need to send whatever I send the court to BW?

Do you think it is worth sending the letter beamerguy proposed about BW and their abuse of process nearing fraud, following the Southampton judgement against them?

Yes, we think that Beamer's advice is gold plated wisdom.

Do I need to send whatever I send the court to BW?

That would depend on what you send to the court an you not find the answer to this  in the newbies and/or court guidance notes,  which you are expected to read.

This is not an appeal , it's a bundle containing the WS , Exhibits plus summary costs assessment which your Court order tells you to serve o both Court and claimant

One bundle to be dropped into the Court to their Dropbox or security , ideally a paginated ring binder

Second bundle to be posted to the claimant named on the court documents , probably the solicitor , post with a free certificate of posting from the post office counter , not signed for

The third bundle you take with you on the day of the hearing

The bundle to the claimant can be just stapled together, no need to run to the cost or the hassle of providing them in a ring binder.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • CM you are a life saver. I had to go and buy printer ink yesterday but luckily I haven't opened it yet! Just going to read that thread properly before firing everything off.
