    S43 relates to formation of contracts but S44 relates to execution of contracts - two entirely different matters.  IANAL and am having difficulty trying to interpret the subtleties (if that is what they are) between the two.  What is clear though is that in order for the contact to be executed it has to be signed in accordance with S44
  • I have had a APCOA pan deposited on a windscreen at Luton & Dunstable Hospital. Their car park is being rebuilt so we parked in an area earmarked for "friends" of the hospital who ferry patients.  My friend was driving my car (because I am unable to drive until I've had an op) to see the surgeon.  It should have taken 15 minutes, but I had a two hour wait because the surgeon had an emergency.
    Can you please help me avoid the £70 charge?

    Did you read the NEWBIE sticky before you posted on someone else's thread randomly?  Best advice is to read the NEWBIE, then start your own thread and then complain to PALS at the hospital.  No further replies on this thread please.

    Yes you do, its in the forum sign up that you clicked through and agreed to
    NEW THREAD button on the front page. You msut also read the NEWBIES THREAD, also on the front page. If you cannot see these, use a laptop and a good browser. 

    Le-kirk -> a contract can be agreed under S43, but its terms only become binding once executed. 
  • Bit of a moot point as there appears to be a £1200 fee to appeal, but can a contract be agreed under s43 but not be executed properly if not in accordance with s44? So can the contract itself be a ‘document’ and therefore not in accordance with s44?

    I did feel as though the rep and judge were cosy. Especially at the end when the rep said, “see you at 2 again (didn’t catch her first name)”.

    That was my reading of it using my non-legal brain and engineer's reasoning.
  • How long does it usually take for the judgement to arrive? I’ve got 28 days to pay but haven’t received anything from the court yet.
