Call the court and ask. Have all your proof that you sent WS and evidence to the court to hand.

You should have handed your bundle into the court in person and obtained a receipt

You should have posted a copy of the same bundle to the claimant

Email is unsuitable and can have issues , especially as courts usually have printing limits like say 50 pages only

I am amazed that you thought it was ok to just send off 2 emails and think it was done with no checking of receipt and acceptance

Call the court asap and check

The reason I sent it all via email is because this is how they requested it so I sent everything via the email the court specifically gave to me. I have been trying to call them all morning so shall keep trying.

To which court? Not the Northampton CCBC? I hope not.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

That was my point , plus not checking with the court and claimants that the bundles were received and accepted and filed correctly , which you should have done anyway

Dropping the bundle into your local court and obtaining a receipt from the court clerk would have avoided this fiasco , and you are ringing the court anyway so prevention was better than cure , this is in addition to your emailed submission anyway

And does your local court have a printing limit of say 50 pages ??

Do they charge you £75 for printing ??

If you don't know , find out

Plus posting the bundle to the claimant with a free certificate of posting from the post office counter is belt and braces to backup your email

I hope you did not email or phone the CCBC? They have no involvement once it goes to your local county Court
  • Hi no I emailed the relevant court as stated in the letter that they had sent. I rang them and they said it was their mistake and they did have everything and to ignore the letter so everything has been cleared up.

The court date is now in a few days time. Is there anything else I should be reading or getting to grips with before the hearing?

Watch the what happens in court video

Ensure you have a skeleton defence with you as an aide memoire

Make sure your costs schedule has been submitted to your local court

Bone up on what your main defence points are

Read completed court case threads on here to see what they did , plus read their after court reports to look for nuggets that may help you , like arriving early , signing in , not speaking with and not accepting documents or papers from the claimant in the waiting room , what to call the judge , taking proof of loss of earnings like wage slips with you

Have you got recorded proof of that phone conversation, for when you rock up and the Judge hasn't got any of your submissions because no-one has printed them out, and he/she will then want an extra copy and have to read it all on the spot?

It's better to send the court a file of papers, not an email, and if you submitted a dozen or more pages then how do you know they've printed it? I would be sending in a copy in a file, with your costs schedule now (send a copy to the Claimant too, unless you've already done the costs schedule).

Thanks guys, so the court have just rang cancelling the hearing because there isn’t a judge available so it is now going to be rescheduled for some time in the new year... how frustrating! I will read up on what you’ve said above and watch the video in the mean time. Due a baby in a just a matter of weeks and was really hoping to get all of this over with before then

I’ve had to create a new account because I was locked out of my old one. They’ve finally changed the date of the court hearing and it’s coming up soon. I’m on maternity leave now as a single person and am struggling to find childcare for my baby. Is it an issue to take her with me to the courts?
