Right, have I massively overreacted here? Are the chances of the keeper having to pay up/end up with a CCJ very slim?

So l need to email the DPO at Smart Parking Ltd to confirm my address and to delete any previous ones, as well as the SAR. Is there a template for the SAR or do I formulate it myself?

Yes. We always defend court claims and only about 1% of people who follow all our advice, actually lose, and they would pay LESS than the sum being demanded now, as they've inflated it.

    Yes.

    Yes - guess where? :)
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sorry, I know I'm a prime example of your worst nightmare on this forum.

    I really am grateful.

Not at all - you are getting there and you have sussed what to do and calmed down.
    So it's all good!

Go to the NEWBIES thread and do CONTROL & F for the acronym SAR.

Should I send the rectification notice in a separate email? I can't see a template for this on the NEWBIES thread so I'm assuming I'm safe to do this myself?

I would put it in the SAR email as a sub heading at the top, or just say:

I am writing to you, the Data Protection Officer, for two purposes:

    1. blah blah about the rectification notice

    2. blah blah - use the SAR template..

What happens with council tickets? Could they result in CCJs?

Find out if you have a ccj registered against you and take it from what you discover.

But you will get best advice over this by taking it to pepipoo

This forum majors on private parking invoices rather than proper council tickets

I've sent the SAR and Rectification Notice. I also called B&M who said that they can't do anything and that all appeals must go through Smart Parking.

What happens next? I've read the Newbies section but still can't see how the keeper of the vehicle wouldn't end up paying in this situation.

It's too late for any "appeals" now.

Now await a court claim arriving

In the meantime keep up your study of the court process as set out in the FAQ so that you have an understanding of the process and can start drafting your defence.
