    A very key piece of advice here, really important. Smart cannot hold a keeper liable. Therefore please, from here on, do not disclose or hint at the driver's identity. You are the Registered Keeper of the vehicle, you state that on any correspondence or phone calls about the Smart PCNs. You can then describe what the driver did. The use of the royal 'we' is helpful .... 'we went shopping in B&M ...'

    Hi all.

    After sending a SAR and Rectification Notice to Smart and Gladstones - I am yet to receive a response and it's been almost a month. What do I do now? I've sent them an email to chase it up. Is there anything else I can do? Worried about potential CCJ action.

    Has it been almost a month or has it been 30 days? PPCs have that long to respond. If it is over 30 days, send it again and tell them if they do not reply within a further n* days you will report them to the ICO - and make sure you do!

    *Insert a number with which you can deal, personally I would give them 5.

    You mean court action? Not the same thing.

    There is no CCJ risk, not even if you lose (because if you lost at a hearing you would pay within 30 days = no CCJ remains) as long as that old address was rectified so there's no danger of missing a claim form.
