Royal Mail still have no record of my letter being delivered, although I know it was as I had a response and return of my cheque.
What do I put in letter 2 as you are supposed to say when they received the initial letter.
Stupid Royal Mail!!!!
Thanks

Hello LM,
You need to send the letter in Wellers post, post 41 I think it is. You need to send it registered post again, I know it didn't work before, but it is one of the best ways to send (usually). You could try sending it normal post and get proof of postage, but if they have had to sign it then you have proof that it actually arrived.
Let us know how you get on!

Thanks Gale but that didn't really answer my question.
Maybe I didn't make it clear.
I know the process now but in my second letter I need to say when they received and signed for the first letter. I cannot do that because the Royal Mail don't have any proof it was sent even though it was as I had a reply and returned cheque.
Thanks

You are entitled to 'assume' that a letter posted by first class post, will arrive two days after you posted it. The 'signed for' service is just additional insurance.
The fact that they returned your cheque, and 'acknowledged' the contents of your letter in their own letter, would, in itself, be sufficient to assume that they had received your letter.I am NOT, nor do I profess to be, a Qualified Debt Adviser. Received today from Robinson Way.
Further to your recent correspondence we did reply to your previous letter on the 23rd November returning your 1.00 cheque. We confirmed in the letter that we are awaiting the documentation from our clients and this will be sent to you as soon as we receive it. In regards to the above outstanding balance you have been making payments since March 2004 to November 2007 this suggests that you are fully aware of the above account.

They have until 5th Jan to produce the required documentation.
What do you think this letter means?0 -

It probably means that they will be unable to provide the cca, as legally required.
Take no notice of their 'inherent' threat - they still have a legal obligation to provide you with a true signed copy of the original cca, without which they will be unable to enforce the agreement.I am NOT, nor do I profess to be, a Qualified Debt Adviser.
