Everyone's case is different.
I need to know how likely it is that it will be set aside and then how likely it is that I will win the court claim.
Will reading the NEWBIE thread and other threads give me that info?0 -
Reading other set aside threads will show you these trends:
99% likely here, with our help.I need to know how likely it is that it will be set aside
I can only recall one not set aside, about 2 years ago when the person didn't prove that they had moved house, so the Judge wasn't satisfied that they had no chance to dispute the claim.
We do these EVERY WEEK and so it's 99% successful. MUCH higher than setting aside any other kind of 'debt' claim, due to the dodgy industry's conduct and the fact it's not a proven debt anyway and they are always defendable. Judges know a bit about them.
The NEWBIES thread tells you this - guess what? 99% success rate here!and then how likely it is that I will win the court claim.
Best local courts, where the Judges know that PPCs operate a scam - Manchester, Skipton, IOW.
Worst - Swansea and Poole.
Where are you?

I am in London. Barnet.
I think I am going to do this. If I lose it will cost £255 twice, right?
I would rather lose fighting because you have no idea how much I hate these companies. And BW Legal.0 -

It wil come as a shock and surprise to you to learn every case is not different. Set asides are essentially all the same. People move and don't receive court papers.
That is in essence it. It is what has happened to you and happened to everyone else seeking a set aside.0 -
It's just my personality. You know I actually taught myself to drive when the new changes to the test came in. With my boyfriend in the car (who has a license but has a fear of driving). And I passed my test in Enfield using our own car, a convertible. All because I just could not stand the greedy, obnoxious driving instructors around me OR the stupid test. Enfield is one of the hardest in the country.
AND I was given these PCN's when I was a learner and I knew nothing about private parking companies. I genuinely thought it was just a council thing. It was the 26th December. Machine and App were not working so I thought it was for free by the council as they do sometimes. I didn't know about ANPR either then.
This is really really unfair.
I actually got a Britannia parking PCN cancelled by the manager of Waitrose. WHO the !!!! knew they were in a Waitrose car park!? The signs are extremely misleading.0 -
Yes, but everyone's case is quite different, no?
I learnt from here that is was rare they even took you to court and mine went court.
Even when they know their machines were not working! Or the app. They even cancelled a PCN I had on the 23rd for the exact same reasons. But not this one.0 -
GREAT for your defence in due course, once the set aside is under your belt. They even cancelled a PCN I had on the 23rd for the exact same reasons.

The actual ticket case will have minor variations but all set asides are essentially the same. You move and don't get paperwork. That's all there is to it really.0 -
How much are BW lying legal asking for to NOT enter the CCJ on your credit file?
If its the same or similar to the £255 set aside cost you really need to ask yourself is it worth it. Nobody on here ever advises paying the scumbags BUT the experts on here are also very realistic, they deal with these scammers all the time, emotion free and beat them ONLY by persuading a Judge with Legal technicalities.
Whilst I understand and agree with your anger (believe me I've been there) it will get you nowhere, the scammers aren't interested, the Judges don't rule on emotion and at the end of it all, ONLY YOU LOSE!
You are at the stage now where you have choices on which way to go BUT there are time limits with those choices, if you pay what the scum want then your done, no more time wasting, end of stress!
If you choose to set aside (and you will probably get set aside based on your circumstances) then you STILL have to defend the claim and that takes a lot of time and effort, its more than possible to beat the scammers (99% win rate here) but get it into your head, they really don't care which way you go, until the new Parking Law comes into full effect they are living the dream.
Read up on set asides and then make your decision, don't let your judgement be clouded by thinking your 'sticking it to them' by ranting because believe me your not.0 -
Oh it's worth it - MUCH better to apply for a £255 set aside, than 'with consent'.
BW Legal will want about £250 or more, and then there would be £100 court fee to get a set aside 'with consent' and no chance to defend the claim. Horrible option, nonono.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
