An intention to counterclaim has to be notified at the time of the AOS - too late now.

going forward, my advice to you is DO NOT DESTROY IMPORTANT MAIL & evidence etc until 6 years have passed because this is the amount of time the CLAIMANT has to issue an N1 form via MCOL

its never "over" until you have it in writing that its over, or 6 years have elapsed

so as most if not all of the interim paperwork arrived at your house , its finding out why the N1 claim pack did not arrive that is crucial here, because that failure led to the default CCJ

could probably include the hotel because they did not get it cancelled and so broke the contract that the £2 paid for
  • Cheers umkomass and good for you. My wife recently got similar NTK from Liverpool airport. Double red lines no stopping at 0515 on a Sunday morning. Stationary for less than 20 secs and no other traffic around. They were pursuing that too as she’d stopped on an emergency route (pre dawn so couldn’t see badly worn double red lines) suddenly dropped when I asked how they could claim we blocked an emergency route when their video van was parked across a crash gate (one of emergency access routes to airfield) bunch of crooks the lot of them. Shameful.

The LJLA and VCS axis is one of the worst. VCS pay LJLA £25k per annum to ‘farm’ the site and also pay LJLA a bounty on every ‘parking’ charge paid.

Glad you were able to shake them off, as they seem much more persistent than to be deflected by a response such as you/your wife made.

I’d only fly from LJLA in the absolute of emergencies. MAN is better, although their recent wheeze to extract coin from their customers via the £3 - £4 drop-off charge sours things considerably.

It used to work far better before they started panicking and confusing people in the congested drop-off area, the herringbone entry/exit was a very smooth-flowing configuration to ensure the velvet transition from drop-off to vehicle exit.

  • Lesson learnt red.
So I can’t counterclaim as I had to do it on a form I hadn’t got?
I get your point too but if I ain’t had it I can’t do anything about it. I’m an honest member of society and worked in and around courts and legal system too so I get it’s didficult to prove I didn’t get it other than I didn’t. Had I done so I’d have dealt with it as I did with the NTK and subsequent threats.
  • I think having worked on RAF airfields for many years and pointing out their reason for enforcing an ‘emergency route’ when their van was completely blocking a crash gate made them think they’d look stupid in court.
  • But we declined to name the driver, car is insured for all our extended family over 25 so bit fruitless pursuing that. I travel s lot with work and point blank refuse to fly from there again. I’ll pay the supplement to fly from where I can apart from there.

I would have thought that if you get the CCJ set aside, then you could counterclaim at the same time as submitting your defence to the original claim, paying your £25 or whatever (varies according to the claim amount)

CEL would have had to adhere to POFA (which they never used to do) in order to make it stick against a KEEPER, the law protects the keeper unless they adhere to POFA

checking your NTK will tell you this and is well documented in that NEWBIES thread
