By the way, expect a long hold on the wait to get through to anyone at the CCBC - budget on half an hour plus, making contact very early might help, but no guarantees.Please note, we are not a legal advice forum. what troubles me is that in order for all this to happen , several or a dozen or more letters have not arrived or have been thrown away or whatever
CEL should have replied to your initial NTK appeal to the postal NTK (which came to the correct address) , within 35 days , with a rejection and a POPLA code , sent to your address obtained from the DVLA query (KADOE enquiry)
then you would have received several debt collector letters to your actual address
and then you would have received the MCOL claim pack including an N1 form from the CCBC in Northampton to your actual and current address
all prior to the CCJ you recently DID receive at your actual and current address
so all of the in between letters have not arrived , but the first and last DID !
its how to convince a judge using the 6 point draft order for a set aside process and your £255 that troubles us all, they do not have to grant it, so it would help if you do find the cause of all the missing post from CEL , all the missing post from their debt collectors , and the missing claim pack posted by the CCBC
all the advice and information and help you are asking for is in a detailed section at the bottom of post #2 of that NEWBIES thread I pointed you at, including links to various examples
read the 6 point draft order process , because you need to convince a judge , not us
and deffo do the SAR,s to CEL , maybe the DVLA as well , plus the CCBC etc too
the CCBC paid compensation to some of those affected by that missing post0 -

I think the cat has an extremely important point. If the DVLA was iffy they couldn't have sent an NTK. They did. To the correct address.0

it will be the address on the court claim that will be important , very easy for them to amend door number or postcode in order to get a default
especially in a case they would loose , you pay £255 but never get it back as they drop claim0 -
Hi Red. It wasn’t all the post by any means. As I stated I received numerous letters from CEL inc the appeal rejection.
On each occasion I contacted the hotel to be assured that the case had been cancelled by them.
That i hadn’t heard anything for a number of weeks is why I destroyed the mail I did have along with last years bank correspondence and all other out of date financial mail a few weekends ago.
From what I have read so far the only letters I haven’t received are the pre court letter from a solicitor or whoever and the court pack. I checked everything I destroyed as I was also looking for a cheque from Lloyd’s bank that hadn’t been cashed but coincidentally I hadn’t got that and they’ve issued a new one. Anecdotal/circumstantial evidence maybe but shows that post does and has previously gone missing.0 -
Umkomass wasn’t referring to a DVLA system dropout. I think he meant Northampton county court had a comms dropout.0
