    If anybody thinks this is fair then you need to think about this. I would have basically had to arrange my house move around Virgin's contract demands, unfortunately I wasn't prepared to do that! I won't be signing up to anything like this again.

    I had a run in with Virgin in the past so I can sympathise with the predicament, but there was a minimum contract term and I guess the fact you moved and couldn't transfer the service is irrelevant (contractually at least)
    Refusing to pay and then blocking all contact was definitely not the way to go.

    You may feel that you "stood your ground", but the price for that "stand" is this blemish on your file.

    What is weird is that I have since got a bank account, mortgage, house insurance, car insurance, credit card, mobile phone etc - it's
    odd that it is only now it's become a problem - interest free credit card so maybe it's that type of credit that will give me an issue. Weird though that I can get a mortgage as that's a bigger risk.

    Going on a purely factual basis (ignoring the moral/unfair aspects of the problem), there was an obligation to pay written into your contract and you have failed to make a payment. As such Virgin has recorded a unpaid debt (default) against your name, which is well within their rights to do. This will remain on your file for 6 years from the date it was recorded, affecting your ability to get credit until it is removed.

    The moral aspect of it may be harder to argue to them, although you may be within your rights to complain. That said, this would probably take a while to resolve and it would almost inevitably go to the ombudsman, which may then take a while to reach a decision.


    No one is denying what is written in the contract, the question is weather it is fair to the consumer to be asked to sign such a document, as it places unnessessary restrictions on the signee, most people dont bat an eyelid over these sort of contracts until they find themselves in the OP`s situation.


    I think its right and proper to challenge arcaik contract restrictions such as this, and it appears the regulators feel the same way.

    Nothing is stopping customers reading their contracts before signing and questioning any terms and then either requesting amendment or not signing and looking elsewhere.

    Because a mortgage is a secured debt against the house and they can take that away from you. The same with a car loan - they can reposses the car,

    Unsecured debts such as CC's and mobiles etc. are not secured against anything physical (other then the card itself which they can block and and phone SIM card they can also block/cut off).

  • You do it via Experian directly.

    But they will just contact the lender/provider for clarification.
