I looked through the Newbie section but fail to see what letter I need to send to UKCPS ?!
I also have contact Costa via facebook and basically said how they are treating customers with penalty charge whilst being their customers and asked if they can step in to cancle the charge.
So, waiting for reply on that!
Just unsure what to send to UKCPS in meantime!? Just worried that after 14days it be £100 and then even more ....

you should pay UKCPS and be done with it , asap, because any other action could lead to you being prosecuted, and if perjury happened then your dad could be in trouble too
my earlier advice was for a driver who was driving legally and with the keepers permission and didnt want the keeper who is not an english speaker from being taken to an english court
once the story unravelled, my advice was that YOU pay this NTK asap and avoid all the illegalities coming out where the penalties and punishments would be higher
an illegal driver will find it difficult to convince a judge that they should not pay a pcn and they could also be reported for those illegalities you mentioned ear;ier (like TWOK and not being insured etc)
nobody here is going to aid and abet a criminal act that should have had the driver arrested and prosecuted0 -

if your dad gets involved with this saga then legally he is liable and accountable for allowing the driver to take the keys and use the car, or its TWOC
aiding and abetting a driver who isnt insured and doesnt have permission to drive means he is liable for that as well as this PCN
he cannot pass that onto the driver when that driver was illegally driving without the keepers permission (TWOC) , so in legal terms the buck stops with him as keeper
we are trying to stop you from getting him into further trouble, but you have blinkers on
you are lucky that you are not before magistrates for taking the vehicle without consent and uninsured, hence why you should pay this charge and move on
I cannot believe that you wish to drop your dad (who is a carer and does not read or write english) into legal trouble over this by getting him to aid and abet a criminal act , the brother of that solicitor MP got ten months for doing a similar thing

How am I !? I dont get it!
Lets forget that I told you about me driving it without his permission and uninsured, right forget it for 5 minutes.
Now, they ukcps don’t know who the driver is, or do they!? I think they dont!!
So, my thinking is that my dad replies via the letter to object it for reason “”not seeing the label, parked outside costa thinking is costa’s parking and that 16min overdue is silly asking £60”.
So, by this, i am not getting my dad in trouble as they won’t know who the driver was.
I mean, am i wrong in thinking this!
Look, i never dealt with such case ever before nor in courts or whatever ... this is all new to me , and trying to understand all this and put the puzzle together.
Bottom line, i learned a big lesson!
I am unemployed myself and £60 is not easy money you know ...

he can do that , no problem, and they will refuse his appeal
after that , because he has not named a legally insured driver that has permission to drive his vehicle, he remains liable and can be taken to your local civil county court within 6 years and they will ask for the £100 plus court costs (about £200) and HE (not you) will have to defend himself by writing letters in english and getting an interpreter as well
if he tells them who was driving and they ask if the driver was legally insured and driving the vehicle with permission, he will have to tell the truth or lie in court, which is perjury
should he name you as driver, this could all come out and you will face all the charges yourself
the easy option is pay up asap, and keep a lid on it
you have been told this numerous times due to your admissions, because all the earlier advice is for when law abiding citizens are involved
I find it very strange that after 20 years you do not understand that lying under oath is perjury , that TWOC and not being insured mean you would be liable to go to magistrates court for those 2 charges
plus your dad would have to tell the truth and so either you (or he) would still have the £100 plus court costs to deal with , or a CCJ , plus everything else
no matter how much we tell you , you are too stubborn to realise that you can swerve this by paying the money and avoid you and he getting all this hassle
like I said earlier , follow the laws and rules and this would not happen, but two wrongs do not make a right
so the "what happened on the day" is irrelevant really, and currently your father is legally liable for this no matter who was driving, if UKCPS followed a law called POFA , dated 2012
speak to your father in his language and tell him that the people on the internet say that this charge should be paid as soon as possible, because he wont like the alternatives

@Bucki This is really very simple.
(1) The law does not require the parking company to prove the registered vehicle owner was driving. Indeed that's the point. Fail to deal with this and daddy gets lumbered with the charge and/or a county court judgment.
(2) if the parking company wants to hold someone else responsible then yes, they are likely to have to prove it (unless daddy shops his son for driving his motor without permission). Frankly, I would if I were him.
There are a couple of other bits you may want to think about:
IF
1. the parking charge is unpaid AND
2. It ends up in court AND
3. It becomes clear a vehicle was driven unlawfully
The court would, quite probably (and properly), refer the matter to the authorities.
Taking that into account - and bearing in mind you may not want daddy to name you as driver (which risks the same peril - i.e. a paper trail that leads back to the illegality/irresponsibility) the lesser of the evils would probably be to suck it up and pay. Count yourself lucky the fuzz didn't stop you.
I appreciate £60 is big money whilst unemployed, but since part of my insurance premiums each year is set aside to fund the MIB as insurer of last resort (compensating innocents injured by uninsured people like you) you've already cost me money.
The way forward is clear. There's only really one sensible course, but each man is his own. #I'mOut0 -

I mean, this being the very first incident goes to show that we are a law obidient citizens
I overpaniced and my dad was angry with me as well. So, yeh.
Thanks for your time, advise and being patient with me. I assumed a get out of this (without paying) would be easier ... especially after reading here a lot of comment advising “dont pay the scammers, ignore...” and yeh.
For getting papers ready and translation, would be taken care by myself anyway.
Well, will need to loan the money from friends and get this fixed.
