    Hi everyone, I've been disputing this one since January, and repeatedly told BW Legal that whilst I am the registered keeper of the vehicle, I am under no obligation to divulge the driver's identity. During the initial 'discount period' I did try to pay to just save the hassle, but the system didn't work and I ended up emailing the parking company. Now BW Legal are saying that this email counts as liability being accepted. This smells fishy to me, but I'm no lawyer. Has anyone had a similar experience or know what to respond? They also naughtily stated that their most recent letter was sent on the 5 June, and I have 10 days to respond, but only received it today.

    If you did offer to pay it, did you do so without prejudice? As keeper, of course you can pay it if you feel the urge to fund a scammer. What exactly did you "email" to the PPC when you made the offer?

    Just reply and say:


    Dear Sirs,

    (a). there was and is no admission of liability and as a matter of law, there is no keeper liability possible, so it is absurd and disingenuous for a solicitor firm (whose first duty is always to the court) to say otherwise;

    (b). the keeper will not be paying, so either proceed to court or alternatively, pass the debt recovery epic fail case back to UKPPO, so they can crawl back under their stone;

    (c).  The keeper cannot be pursued for a sum in excess of the parking charge as it stood on the day (£100) so kindly explain the added 'damages'.  How did they arise, what do they cover and who keeps that money if paid? Are they BW Legal's costs?

    "Hello,
    I've tried multiple times over the past month to pay my fine, including within the 14 day discount period. I've tried at least 5 times online and 3 over the phone to no avail - your online payment portal is temperamental at best - only once out of the 5 times did it take me to the actual payment page, and after I got the 'Payment confirmed' screen, I thought I was done. I have since received a letter stating I haven't paid, and after checking my account, the payment has not gone out. How am I supposed to pay?
    I would appreciate a swift response, and if possible to be able to pay the discounted amount, as it is through no fault of my own that I did not pay during it."

    Their argument is,

    You tried to pay thus it could be presumed you have admitted liability.

    Your argument is,

    They refused your payment thus it could be presumed they have denied your liability.

    In any case, it is not a fine nor a penalty.
