Does it matter if UKPPO are chasing under bylaws or contract?
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -

For them to chase under byelaws they'd have to go through magistrates. They're not doing so.peter_the_piper said:Does it matter if UKPPO are chasing under bylaws or contract?3 -
All of the comments here seem to be from people who live in England. I've been told that it is difficult for the parking companies to pursue a private parking "fine" in an English court when the person being pursued lives in Scotland. Is this correct? If so what makes it difficult?

Because a claim would be defended at the individual defendant's home court. Scotland is out of jurisdiction of the England/Wales court system. It's not an absolute guarantee, but it would be significantly more difficult to prosecute a case north of the border and (seemingly) much more expensive. Why would a PPC spend well in excess to recover a mere £100 via a 'foreign' court system of which they have no experience. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

If you believe the laws are the same in the 2 or actually 3 nations , then what was the point of devolution ?1

While not wishing to become involved in a political discussion may I point out that the Scottish legal system has always been separate tothe English one. That, however, was not the question. I live in Scotland but the alleged offence was in Newcastle Airport. It is not possible to transfer a case between English and Scottish courts but English courts have no jurisdiction in Scotland. There is nothing in the Sticky about this subject.Redx said:If you believe the laws are the same in the 2 or actually 3 nations , then what was the point of devolution ?
