    OK thanks Keith. They have deliberately made this confusing..unclear whether I should appeal to PCS. Will have a look again at the thread!!

    Yes, don't mention GDPR.

    There is nothing in GDPRs that stop a PPC passing your details to their agent for debt recovery purposes.


    You could, indeed should, report to the BPA that SaS has passed the matter on to a debt collector before your appeal has been determined.

    no reason why the KEEPER cannot appeal this to PCS, the main point is not to pass on the drivers details and not infer who was driving

    but a BPA AOS complaint may help, because any rejection should include a popla code but PCS may be doing the back office work on behalf of SaS (which does happen)

    so use the blue text template and appeal as keeper to PCS, if that is what they say

    but DO NOT reveal who was driving and ignore the requests for drivers details

    the idea is to get the POPLA code, no matter how long it takes, and no matter how confusing they make it


    yes you can complain to the M.A. of the site or the landowner, or both, but you wont get to see any contract as they will say it is commercially sensitive and wont produce it, certainly not until court anyway (if that happened)

    and GDPR is a dead duck for you at this time

    plus the BEAVIS case wiped out your argument about the charge being excessive, that Supreme Court judgment was 2.3 years ago now !

    The reason the car was parked there was because of a recent change of contract - previously it was ok to park there..I don't think the signage was clear enough about this (those specific spaces and the change) but I doubt the contract included enforcement for those spaces, though it may do.


    The photo of my car parked there shows no other cars on the entire floor - so from this point of view I would say the charge is excessive as the cost would have been only £5 for the day and there was hardly a loss of income or lack of space for other cars.


    But I hear what you are saying - I won't focus on the excessive charge.

    DO NOT ignore the PCS NTK.

    It is the Notice to Keeper, as the NEWBIES thread tells you, not a debt collector letter.

    I hope you didn't hand over driver's details when SAS emailed you?

    Oh thanks Coupon Mad. Not helpful that it is unclear what the letter is! No I haven't said who the driver is on any correspondence.

    when the new Code Of Practice comes in we hope that the paperwork side will become very clear, and the signs etc as well, the Lords are debating it tomorrow, so hopefully some of the issues will disappear, not that it will help you with this one

    but as CM mentions above ,treat this PCS letter as the NTK and appeal it as KEEPER, regardless of what has gone on

    the idea is to get a popla code , EVENTUALLY
