County Court Claim From Britannia/BW Legal - Please help

I have received a letter through (dated 01/02/2019) from BW Legal on behalf of Britannia Parking. The letter is a claim form from county court business centre Northampton.

The car was parked in a carpark that has been free since it was made 40+ years ago, but they had recently taken it over and made it "free" upto 25 mins. the car was in the carpark 17 mins over their "free" time.

BW Legal/ Britannia are claiming for a principal debt, interest, court fees and solicitors costs.

I have read through the Newbies thread but find baffling, too much jargon i got confused.

The letter has not been acknowledged, I assume that is the next step?

Could someone please help, I would really appreciate it.

    You will need to do the Acknowledgement of Service next and KeithP is the resident guru for confirming when your defence will need to be in by :)

    Sorry but you really need to read the second post of the NEWBIES thread.

    It is easy to do the Acknowledgement, you could not ask for an easier guide!

    And re the defence there is no quick fix, and certainly do NOT trust any poster who sends you a private message offering to 'help'. DO NOT TAKE IT OFF-FORUM.

    All you need is in the NEWBIES thread so try again, please. We can't do this.

    If so...

    With a Claim Issue Date of 1st February, you have until Wednesday 20th February to do the Acknowledgement of Service. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

    IMPORTANT: Do the AOS today or tomorrow.


    Having done the AoS, you have until 4pm on Wednesday 6th March 2019 to file your Defence.

    That's just two weeks away. Loads of time to produce a good Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    6. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    I have done the Acknowledgement of Service now. I am just typing the SAR now
  • I no longer have the car so cannot send the V5 as ID. Is there an alternative to my drivers licence or Passport I could send?

    A copy of your Court Claim Form should be be good enough.

  • I sent a SAR to DVLA and they didn't seem to want anything like the V5 number, just the reg.

    For the SARs I sent to the PPC, I sent a heavily redacted copy of my passport as proof of identity.

    But the DVLA always reply by Royal Mail to the Registered Keeper's address they have on file. No risk of personal data going astray there.
  • I saw this template, this should do the job right?

    Also am i right in thinking that if I lose it court, so long as i pay within 28 days I won't actually get a CCJ? I really cannot risk one right now!

    Please supply the information about me I am entitled to under the Data Protection Act 2018 and relating to:
    •​Any and all Documents mentioning my name or any details relating to myself i.e. vehicle registration/contact details/ PCN number etc
    •​Full email history and the emails mentioning PCN number, myself or vehicle registration/contact details etc
    •​All interaction made with any other private company where data regarding my PCN number/vehicle/details have been discussed.
    •​A list of all telephone calls made where my PCN or details are mentioned and details of what was said.
    •​Of Particular interest is any documentation trail showing how and who has sold/passed my details relevant to the PCN or personal details.
    •​Copies of all documents/email/ or communication by any other means
    •​Full disclosure of all information held about myself, my details and or my vehicle
    •​Details relating to what information is viewable by any external companies handling mail on your behalf, i.e. are envelopes sealed prior to being issued to mail handling companies used if applicable.
    •​I request a full itinerary of what happens and what stages my data is processed under whilst in your database
    •​Proof of the rights you have to manage my data
    Also any Photos taken of the vehicle.

    It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month and that under new GDPR Data Protection Act 2018 no fee is payable.

    Please see attached a copy of a claim form from you as proof of ID.

    If you do not normally deal with these requests, please pass this letter to your Data Protection Officer, or relevant staff member. If you need advice on dealing with this request, the Information Commissioner’s Office can assist you. Its website is ico.org.uk or it can be contacted on 0303 123 1113.
