County Court Claim From Britannia/BW Legal - Please help

    You are right, if you lose and pay the amount the court orders within the timescale ordered, usually one month, then effectively no CCJ will be recorded.

    As well as the vehicle registration number, I would include any PCN number(s) too.
  • I do not have the PCN. I have no letters from Britannia parking, only BW Legal.
    BW Legal letter does have a PCN/T number, I assume it is that

    Yes it will be.

    The SAR will show you all the data and photos. Did you throw the Britannia letters in the bin, or never got them?

    Were they sent to an old address, in which case, is that because you didn't change your V5C keeper address for the car when moving house?

  • So I received one letter from Britannia a couple of weeks after the date in question, then heard nothing for a good while, so thew the original letter away, but eventually the BW Legal letters started to come. The address has not changed.

    OK well the SAR will get you that letter back, anyway.

    Make sure in your defence, you mention the BPA CoP about new restrictions and the need for very clear signs to alert people familiar with the site being free. I expect you can find the wording used before by someone, by searching this forum for:

    familiar new restrictions BPA CoP

    And include about 'BPA grace periods' too.

    And the POFA/no keeper liability if this was an old 2017 PCN, as I already discussed at length with another Britannia defence poster tonight...

    I always suggest you read twenty or more Britannia threads first, before writing a defence. Simply look back page by page at the thread titles, and read them all.

  • Honestly thank you all so much. I know there is a wealth of knowledge on here, but it can be tough to sift through it all to find the relevant posts.

    I'm about to search for a template for a restriction of data processing to put the case on hold, which should be a fun search :rotfl:

  • Oh? I think I'm getting a little confused... In the newbies thread the restriction of data processing is posted after the SAR bit?

    So now the AOS is done, along with the SAR, I just need to hope the SAR comes back in time to put my defence together? And if it does not come back in time, submit my defence without any of it?

    The response to the SAR will probably be most useful at Witness Statement and evidence stage.

    Yes, like everyone else does on the (at least) twenty other Britannia defence threads we want you to read first, so you are fully informed. It will really help you.

    This is easier than you think; it's been said and done a hundred times this year already, they are that common. Yes people get the SAR back, or occasionally, a cancellation!

    You could literally read/learn from a thread and not even start one and you'd be fine.
