Ccj request set aside Parking Eye

  • Well this is a weird one and Im hoping a result if someone could advise


    I got a letter from the court today, (we used to be able to put pictures on the threads but cant see the facility)


    To the defendant


    This confirms for the purpose of the Register of Judgments, order and fines regulations 2005 that


    This debt including any interest is satisfied


    A notification will be issued to t he keeper of the register of judgements, order and fines for the entry to be
    REMOVED (as payment has been made in full within one month)


    This judgement was registered by the County Court Business centre and the case was transferred to this court.


    This certificate is only valid if sealed by the court.


    Second letter from the court


    We have vacated the hearing as requested. (this was when I said I wasn't going to go ahead with it (yes in a panic as I thought I was done for) but I did call the court and state that I did want the hearing to go ahead and told the claimant the same in recorded delivery letter and the court told me that they had made a note to this effect.


    I then rang the court today .. Watford and asked if this meant that the CCJ was to be removed from the credit reference agencies and they told me yes (but Im not always sure the people that answer the phone are sure about the advice they give)


    Parking eye were adamant that the case was to proceed in the last post that I put on here but I am wondering if the CCJ was heard in court one month prior to me paying it on the 15th November and this is why its been removed or has it just been satisfied?


    I am so confused and as the usher said that the hearing is now vacated as does the letter court sent that seems to be it. The 197.00 that I wrongly paid (I know, I shouldn't have) and the 250 I think it was to request a set aside hearing are gone but if the CCJ is not on my sons file then that's great news.


    I would so appreciate your advise, I wouldn't have got this far without you all

    Why have you posted the same thing twice?

    I'm not clear what exactly you're asking? If the first letter states that the CCJ is satisfied and removed, then make sure you keep a copy. If it is satisfied and removed, there would be no need for a set aside hearing as there is nothing to set aside.

    Asking for advice on the content of the letter received from court and clarification that this infect means the CCJ is not only satisfied but REMOVED from credit file?

    As you know this was paid so satisfied but court is saying as satisfied within 1 month of being lodged (it wasn't it was 2 months) then it will be moved

    Parking Eye said just a few days ago they are attending hearing and it will only be removed if ordered by court... so maybe you can see why I'm confused

    It is not a result to mark a CCJ satisfied, I already told you this in earlier replies.

    A satisfied CCJ is NOT removed unless it was paid within the first month.

    I guess the Court is saying it was?

    This is not a good thing, either way. Just means you were utterly scammed and paid.

  • Just been through all my paperwork again, It states that Judgement was issued against son on 23/10/19, I then went onto pay the amount on 15/11/19 so would have been within a month and this is clearly why the matter was closed and as stated.f you pay within a month
    If you pay the full amount within a month you can get the judgment removed from the register.

    So when I entered a request for hearing to set aside on 15/11/19 after paying the 197.00 I didn't need to, HOWEVER if I hadn't paid at that point we would still be looking at a hearing and judges disgression with the possibility of a CCJ for 6 years ... does that sound a fair assumption?

    Thanks but I would rather loose 197.00 and learn a lesson not only in relation to CCJ's but Parking Pirates and the pitfalls to overcome if this ever happened again, as well as the legislation about RK plus to always make sure Log book is updated as well as license.

    Surely you have worked out by now there is no such thing as a Registered Owner?

    Or is that just the predictive text on your mobile telephone changing RK to RO?

  • so shall I wait until I get confirmation from PE that they will remove the judgement or is that done by the court? and shall I update the credit ref agencies as such. I still cant believe this is it
    All the letters to PE and all they had to say was its satisfied and was done so within a month
  • iv decided to continue now with Barnet General Hospital where I did register my blue badge and used this vehicle many times
    I have requested SAR from Parking Eye who have me jumping through hoops to prove the identify of the vehicle keeper at the time Log Book, Insurance and more

    Once it comes back if this vehicle as I know it has been used many times at this location comes back as such I will ask why if my vehicle was not registered to park in the designated bay did I get a fine on this occasion and If necessary I will consider taking NHS or Parking Eye to court to claim back the money that we lost for the fine and the set aside hearing. Plus interest and the amount of time its taken to write to courts and Parking Eye,.... What you say?
