    Yes I guess as im named then I would get the CCJ which is just devastating for me as its taken me 7 years to pay off my debt and have all defaults wiped from my record and for the first time have a good credit score.

    Also because I did park in a place that I was told I was able to so 6th March is looming and the court know we are attending.
    You won't get a CCJ, just because you are going with your son and admitting to being the driver. The CCJ your son has, can't just shift to you, as you've never had a PCN.

    The hearing is about setting aside his CCJ, and getting the sum paid refunded. There is no case against you, at last not at the moment unless PE start again.

    ParkingEye might struggle to proceed against you (even of they wanted to start again and issue a PCN from scratch, to you as driver after all this) given the known and undisputed fact that you were disabled and entitled to park there and had registered your Blue Badge in good faith.

    If judge agrees with our evidence would they have to return the 197.00 to me?


    We write regarding the above referenced Parking Charge and subsequent county court claim.

    As you will be aware, ParkingEye issued the claim referred to above to recover the outstanding amount. However, as no defence was filed, nor was full payment received within the applicable time frame, the court granted a default judgment in ParkingEye’s favour.

    We can now confirm that we have received your payment of £197 on 15 November 2018 and we consider this matter closed. Please note that we will provide this information to the court in due course, so that they may update their records, but this may take some time to be processed as the court works in arrears.

    Please note that the judgment issued by the court should have stated as follows:

    "Details of this judgment will be entered in a public register, the Register of Judgments, Order and Fines. They will be passed to credit reference agencies, which will supply them to credit grantors and others seeking information on your financial standing. This will make it difficult for you to get credit. […] If you pay in full within one month, you can ask the court to cancel the entry on the Register […] If you pay the debt in full after one month, you can ask the court to mark the entry on the Register as satisfied […]”.

    You may also wish to provide a copy of this correspondence to the court as proof of your payment.

  • I really hope that the CCJ is dropped and to win against Parking Eye would be such a message to other people they have ruined. A message really needs to go out to Barnet Hospital as well.

  • I'm confused - you paid the CCJ AND applied for the set aside (without consent)? Why would you do both?

    If you wanted to pay the CCJ, you should have approached the PPC for a set aside with consent, which would have been £100 for the consent order, and payment of the CCJ in full. It would have then gone before a judge to be checked over and hopefully passed, thus removing the CCJ.

    It looks like you have messed up by paying the CCJ. Thee is now no possibility of a setaside & the CCJ remains on record as "satisfied" for the next six years.

    On matter of I paid the CCJ and now it will mean that there is no point in a hearing as it will be shown as satisfied


    Should I seek clarification on this from court otherwise the whole thing has been a waste of time and money, I paid it because I didn't want it to go any further and didn't realize when I applied for Set Aside that this meant there was no point and now my son has a CCJ unjustily
  • No, you do not need to send any money for a subject access request. You email their data protection officer with the template.

    The new data protection rules mean that it is free to access your data. However, your son needs to do this in his name. Not yours.

    Why are you bothering with a SAR now when the matter is pretty much closed?

  • The CCJ may well be marked as satisfied but it is still on his record. It's just marked as satisfied.

    He could have successfully applied for the set aside which would have removed the CCJ.

    Instead, you had paid for the set aside application (non-refundable), and paid the CCJ (non-refundable, and remains on file).
