Ccj request set aside Parking Eye

  • Sorry forgot to ask does someone have a thread link for a SAR for Parking Eye

No I didn't sent the letter to the court, it was an e mail that came to us from Parking Eye to say the debt was satisfied, but it was satisfied on 15/11 which was the day after I picked up the paperwork and also applied for a Set Aside, I didn't realize that if you paid it then you accepted liability I thought I should pay it and claim it back incase bailiffs started turning up or the debt increased .
  • No, upon receipt of the set aside application, the court will order that any recovery action is suspended. Certainly that is what happened in my case.

I appreciate this is now after the fact, but you could have asked that question here if you were worried about bailiffs.

Slow down. We already know all of this from earlier in the thread.

    - The MUM (our OP here) panicked and paid the charge recently, when spinning around and misunderstanding advice.

    - But the son didn't know that, and has contacted the court saying he wants to set aside hearing to go ahead. It is HIS CCJ and he hearing is going ahead.

    - Looks to me that PE are trying to sneakily get the victim to tell the court it's all OK because the CCJ is satisfied...

    - but the D has not agreed to that and AFAIK the hearing is going ahead.

If PE have been paid then the CCJ is satisfied. The CCJ cannot be set aside. It doesn’t matter who paid the CCJ.

Maybe, but the court know the above and the D has told the court he has not paid or satisfied the CCJ, and that he wants the set aside to proceed.

  • Hindsight. As Iv said I picked up letters my old address Nov 15th for a fine from June. I paid immediately then realised I had evidence for set aside

Letter from Parking Eye today so down to judge now.

We are writing in response to your multiple pieces of recent correspondence.

Please find attached our response to your application which has been filed with the court and also placed in the post to be served to your address today.

We can confirm that we have informed the Court that the amount has been paid in full and we can also confirm that we will not be returning any funds unless the order to do so is made by the Court.

    Yours sincerely,

Theyre hoping that the court refuses the application.

And tell me how many times my vehicle was used whybwoukd this one occasion result in a fine when I had registered my badge at the front desk at Barnet to make use of the blue badge concession
