According to the Courts and Tribunals finder, Hertford Mags doesn't appear to be in service anymore (https://courttribunalfinder.service.gov.uk/courts/hertford-magistrates-court-and-family-court).

Courts are now grouped into centres. Some are being closed down. Thus, just because you're issued/defending in one court doesn't mean your hearing won't be listed in another (less convenient) one.

This is how your government are saving money without you realising (until it's too late). Since most of the public try not to encounter the courts, closures and cuts to legal aid have been brutal and few have realised the extent of it.

Your SON needs to email the court and tell them that he does want to the set aside hearing to go ahead.

Presumably he/you have paid £255 for this hearing so why on earth cancel it?

THIS IS NOT YOUR SET ASIDE HEARING SO YOU CAN'T DISCUSS IT.

This (BELOW) is what a set aside hearing is for, and it's not to have his defence heard.

THE LACK OF SERVICE OF THE CLAIM is what the Judge needs to be satisfied about at a set aside hearing, so your son takes his proof of addresses and explains how he never knew about the claim and has good prospects of defending it (Equality Act related) so should be allowed that opportunity:

But as you've just sent a letter discontinuing, your SON needs to immediately retract that and say to the court, and to the Claimant, that his Mum sent a letter in a panic, and he, the Defendant, DOES want the set aside hearing to take place.

If you have paid the judgement then the CCJ will be "satisfied" so your application to set aside the CCJ is pointless.

Hi I rang Watford CC today and was told that the case to set aside was being heard at Mags in Hertford and this sometimes happened with listings if the CC was full for hearings. I have said I am still going ahead.


Could someone possibly take a look at my defense in post above.


Going to do a witness statement is there anything else I need to send to court?

Thank you for staying with me, I truly appreciate the advise I have been given so far.

Son does want to proceed now whatever the outcome (slightly worried the other party PARKING EYE) Could ask for costs if we loose.

I have gone along the route with my son you advise and supplied the evidence of not living at the address the paperwork was sent to over 3 month period by Parking Eye by means of tenancy agreement at new address living since 03/18 and Electoral role records.

Also provided information to show that the CCTV ANPR picture PARKING EYE have is a woman (me) but appreciate this is irrelevant.

Also copies of my blue badge which was registered at the hospital
Statement from daughter stating we had registered it at the front desk

Going to the hospital this weekend to look at signage and to ask the concierge desk what the process is for registering a blue badge with them. I was planning on capturing the response on a GOPRO.. would this be admissible in court?

Court contacted by phone and recorded delivery letter stating want to continue with the hearing and the person who answered the phone said he would make a record on the file to this effect. (even if he doesn't it is backed up with letter)

So I don't think there is much else we can do now.

I paid the monies that was owing by the PARKING EYE online service and got a payment reference, but cannot trace this payment on my bank accounts now

when I logged onto MCOL it does not show its satisfied (as another one that was received at same time does)

I think because it was set aside its still perhaps pending (hopefully as you have advised that if it was satisfied the CCJ could not be written off.
