Dvla £80 fine for no tax

Good afternoon everyone,

So I have written off my car in May last year and got it scrapped by some guy I found on facebook, my insurance were not aware of it. As a normal person I cancelled my insurance and stopped the direct debit for tax to DVLA. The guy that had collected the car was meant to send everything off and I should have received the certificate of destruction which I haven’t to this day. DVLA had issued me a £80 fine for not having tax, I rang them and said that I’m not paying it as my car is written off and now they’ve got Resolvecall on me! What should I do next?

    You just handed the V5C over with the car, and didn't get anything back?

    Yes - it's your problem, then. It's your legal responsibility to make sure that the paperwork is dealt with when you dispose of a car, whether you sell or scrap it. While you're the keeper, you're the one legally responsible for ensuring it's taxed or SORNed.

    It was ultimately your responsibility, to ensure the DVLA was up to date with your change of ownership etc

    Your own fault. Don't trust "some guy on Facebook".

    Pay the fine and learn the lesson.

    As the others have said you will have to pay the fine, it is your responsibility of letting them know the car has been scrapped.

  • What sort of condition was the car in when it left you?
    Could it have been repaired and put back on the road?
    If the car hasn't been officially scrapped or the DVLA not informed of a change of keeper, you may well start getting parking tickets or speeding fines sent to you depending on what happened to it.

    Even if the car was undriveable, then the person on Facebook still has a car that hasn't actually been reported as scrapped, and all the paperwork to go with it.


    I can't help wondering if there's a stolen car being driven around somewhere, with the all identification marks off the OP's old car.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    Just to say that my grand son did a similar thing, gave his scooter and paperwork to someone from Facebook. When he told me what he had done I got him to write a letter explaining what he had done and a week later he had a form back stating he was no longer the registered keeper.
    So a letter works, send one now to avoid future fines.

    Thanks everyone,
    I have decided that the safest thing to do was to pay the fine as I really don't want to appear in court over £80. Contacted the guy that scrapped my car and he said that it is really bizarre and that he had never seen it before. Also I think that my car is still out there somewhere as he couldn't even provide me with proof that it's been destroyed!

    you need to do a change of ownership ASAP
