Ah I see. You could always do both. Make a claim for time, costs, and inconvenience, and a separate claim for GDPR breach. Both should include Aldi as principle.I married my cousin. Sure, thank you. I’m not looking at this as an opportunity for a windfall to be honest with you, i’m just looking for justice and to help others. If you push back too much and appear too greedy courts don’t take you seriously... But I am insensed to know that others have had to pay these fines because they didn’t keep a groceries receipt (who does these days) and can’t provide proof of where their car was. I’m lucky I have an Electric Vehicle and everytime it charges at home or anywhere else I have a record by VIN number but most people don’t. Starting this thread gives me the satisfaction I need too : )0

I think Fruitcake has raised a good point about GDPR. I think once I receive the official fine cancellation notice from PE what I may do is then raise a complaint against Parking Eye for data misuse i.e. if me/the car wasn’t breaking any parking rules on the Aldi site, which it wasn’t, they had no legal right to access my data via the DVLA. If they don’t respond I will then report them to the ICO - information commissioners office

Thanks Xxxx for your acknowledgement of the error and apology on behalf of Aldi.
Hopefully the fine cancellation notice and apology from Parking Eye will follow very shortly.
Just to keep Aldi in the loop, because our car was not parked in contravention of any parking restrictions at the Aldi site, we will also be writing to Parking Eye about the GDPR breach they have committed.
Parking Eye had no right to access our personal data from the DVLA, contact us, use or store our personal data. And if we do not get a satisfactory response within a reasonable timescale from Parking Eye on this, this breach will be reported to the ICO

Just to say, that PE will almost certainly be agents of ALDI, so if there is a GDPR issue, then ALDI could be jointly liableFrom the Plain Language Commission:
