Advice about a delayed parking fine

    Well they shot themselves in the foot.

    Letter came with NO copy of the hire documents.

    I have them bang to rights, thanks for all your help!

    On another note, had another come through the post from Parking Eye at exactly the same time, for overstaying on an Asda carpark, this time in my own car.

    Follow the newbie template, and see them off as well?

    Went in to the Asda today to have a word about quashing the second notice (after reading a few cases on here)

    They said they'll do that, so a weight off my mind

    Good, but log in next week on ParkingEye's website to check it's showing zero.

    If not, you will HAVE to appeal anyway, using the forum template and adding a line (to replace the bit about PDT machines and VRNs) stating that Asda's Manager has agreed to cancel it as the occupants of the car were genuine customers. Upload proof, a receipt or bank statement. PE will cancel if it's over thirty quid, I expect.

    Anyway this thread is about your Notice to Hirer case and as long as you cite para 13 & 14 of the POFA at POPLA stage, and do not write anything that implies who was driving, you will win.

    As soon as I pass the 21 days, I'll draft up the appeal with Edna Bashers template and pass it to you guys for a proof-read before I submit.

    We have never heard of any PPC complying with POFA 2012 & providing correct delivery of documents in the case of a hire car.

    So I waited until the 28 days following the receipt of the NTH to appeal on MB's automatic appeals service, to then be told it it no longer possible to appeal online with regards to this reference number.

    What action do you suggest I take now, to get a POPLA code?

    Why did you wait 28 days, wasn't it a NTH that only gave 21 days? There is no advice telling people to delay appealing a postal PCN of any description, the only delay we advise it when it was a windscreen PCN.

    You appear to have missed the chance to appeal but it's worse than that - YOU MUST contact MB anyway to confirm that you were the hirer, in case they think your silence means you do not exist, and they will then write to the Hire firm again who will pay it and charge you.

    Your delay has put you in danger of that!

    Send a DELIBERATELY NAIVE email and/or letter to MB (NOT USING THE FORUM TEMPLATE, NOT TALKING ABOUT THE POFA) setting out that you are the hirer and that you wished to appeal but their system wasn't working online. State that you do not believe you are liable and ask for all photos taken and to consider this an appeal.

    include your name and address (postal) and do NOT say anything implying who the driver was, so no 'all photos of where I parked' sentences.

    YOU MUST act quickly as at the moment you've failed to hook it in your direction!

    I an emailing to dispute the parking charge. I tried to appeal online, but the online page wouldn't work.

    I do not believe there is any liability for the charge, and would appreciate copies of all of the photos taken of where the car was parked
