    I think the safety of other road users is more important than any individual, so on that basis the law is wrong.

    You do know that in extreme circumstances the police will allow untrained drivers to participate in pursuits?

    Who (apart from you that is) mentioned a "high speed" pursuit?
    It's quite possible to have a crime committed and for the suspected culprit to drive away at a speed well within the limit so as to not attract further attention.

    If you saw a young child being forced into a car and it seemed obvious to you that something very dodgy was going on and that car then drove off, would you pull over gently to the side of the road, park up and switch off your engine before calling the police? or would you at least make an effort to see if you could follow the car and report what had happened to the police?

    Agreed, but the law doesn't distinguish. In practice, I'd imagine that if our pursuer/pursued were to cause havoc as a result of loss of control, he would more likely be charged with DD or CD rather than mobile phone use.
