I think drink driving is a little more complicated than using a phone... you're either using a phone or you're not. Whereas with alcohol, my understanding (teetotal non-driver...) is that you can have a small drink with dinner and still be under the limit, or might still be over the morning after a heavy night out. That leaves a lot more room for honest mistakes than mobile phone use.0 -

It's a little difficult to have accidentally have a heavy night drinking and accidentally drive early the following morning.0 -

Of course - but you might not realise you were still over the limit? I don't know how long you'd have to wait to be sure. Certainly it isn't an obvious binary.0 -

With drink driving people can be caught out just by having one drink thinking they will be ok and still be over the limit, whereas another person having the same drink at the same time would pass the test. They did not consciously mean to drink to over the limit. With using a phone there is no defense.
Personally I think the drink drive limit should be zero so you remove this element of someone being over the limit by accident.0 -

True I will never be over the limit as if I am driving I don't have a drink at all. However many do as they can and in most cases are allowed to, like you say its a judgement call for those that do and one they can easily get wrong. Hence why it think there should be zero tolerance makes it easy for everyone to know where they stand.0 -

If you drink and drive at best it's poor judgement, you don't accidentally drive.0
