County Court Claim Issued - Northampton

Ladies / Gents...
I parked in a Britannia carpark for 23 mins, I have photographic evidence of my car entering the carpark and leaving it. The first 30 mins are free, supposedly I was meant to print a ticket when I entered/left, I didn't do this. What I can't understand is why I'm being chased for simply not printing out a ticket. The photograph sent to me by Britannia Parking clearly shows; the time I entered and the time I left which didn't exceed 30mins. It seems I'm being penalised for not printing out a ticket, rather than exceeding 30 mins.

I received an email today, see below, from BW legal, I'm really not sure how to deal with, or what to do, any thoughts advice much appreciated.

    this is being pursued because they use parking as a means of extorting money for minor transgressions, its a sc@m industry and needs regulating which MP,s are currently sorting out

    HAHA, you never opened an account with either Britannia or BWLegal, this is pipe dream stuff.

    You know what to do with spam emails ...... mark it as spam and the anti spam email software is so good that it will start dumping this stuff in your spam folder and in others spam folder.
    Bring it on spam folders

    As you say, Redx it's a minor transgression, your term sums up the situation up very well. I'll ignore their email and not give them any further information. Britannia parking were a pretty persistent bunch sending me numerous threatening letters, but this seemed to be new step bringing BW legal in to the equation. Many thanks again for your replies....     Because they can. Because it was allegedly a breach of an alleged contract and they want damages for the offence. It is a scam, complain to your MP


    It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    Hello All.... Some guidance would be much appreciated.

    Brittania Parking / BW legal have:

    "issued legal proceedings in the form of a County Court Claim on 28 January 2019 " County Court is Northampton; miles from me.

    BACKGROUND
    The keeper parked for 20minutes, so shouldn't have paid anything, the first 30mins is free, the problem was not printing a ticket. Brittania Parking sent the keeper a picture of the car entering the carpark and leaving it, all date and time stamped, which confirmed the keeper was there for 20 mins. So the keeper is being taken to County Court for not printing a parking ticket, unbelievable. To date, no DWlegal Account information has been completed by the keeper, but they continue to pester.

    Data files have been requested, but they still haven't turned up, it was only a week ago they were requested.

    MP written to, she described their actions as "completely unacceptable behavior on the part of Britannia Parking" and has passed the info on to the relevant minister.

    As I say, advice / comments much appreciated...

    Edit: do you even have the claim form? Or is that just the letter from BW LEgal?

    County Court is Northampton; miles from me.
    It won't be from Northampton County Court, it will be from the County Court Bulk Centre in Northampton - simply a distribution centre handling the thousands of incoming small claims via the MCOL website, then putting them in envelopes and posting out.

    Any hearing will be at your nearest county court.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Hello... Nosferatu... No, the notification came by email yesterday, from BW Legal. The only document I got was an attachment, explaining how I should make payment. Further advised "you will shortly receive directly from Northampton County Court (County Court Bulk Centre) as you have failed to make repayments on your above account"

    At the bottom of their email was the statement; "f you do not contact us or reply to the County Court Claim before 19 February 2019 , we may enter a County Court Judgment ("CCJ") against you"

    I've haven't followed post two, or acknowledge recpt of their email. Big thanks for pointing me in the right direction. I'm guessing there is a set of questions I need to hit them with.

    Do you know what the minimum amount of information I need to give them, for example my phone number.

    I'm interested to see what the charge is and how it's worded. I can't believe these people.
