    If he didn't see the OP, then he is in breach of rule 202 of the HC, at least.

    If he did see the OP, but continued regardless, then that comes within the definition of dangerous driving.

    The OP may have failed to see the car, but he was under no obligation to look.

    Are you suggesting that a pedestrian (or even a runner), on a footpath, has a duty to look into every driveway before proceeding?

    It's certainly wise to do so.

    Especially when you're already stationary because one car's already emerged.

    Yes for self preservation purposes if nothing else. Were you off school the day they taught the Green Cross Code?

    I left school before it was invented!


    However, I do know that neither it, nor the Highway Code, have anything to say on the subject in hand. The GCC is all about crossing roads, not proceeding along a footpath.

    Common sense would agree with you, but I can't find a word in either the GCC or HC to support it.

    Not really. I imagine the great majority of my contemporaries who have not survived to my advanced(?) age have been victims of cancer or other diseases, rather than road casualities.


    And even those younger than me who had the benefit of the Green Cross Code have not been warned about the dangers of cars reversing out of driveways!

    What happens to me is this-


    I'm walking up the road with The Dog.


    Someone comes out of their house, glances into the road and gets in their car. I could wave to them if they looked at me...



    I'm still walking steadily up the road.


    They start the car.


    I'm still walking steadily up the road (I can clearly see them in their car as I get closer, they could even see me if they looked around)


    They sit in the car, applying makeup, shaving, reading the paper, facebooking etc.



    I'm still walking steadily up the road and I get to the drive.


    At the very instant that I cross their drive, the reverse lights flash on, and the wheels start spinning as they shoot backwards without the slightest warning, to stop when the back wheels drop into the gutter to look if anything is coming.


    My catlike reflexes, plus the fact that one of us (me) has actually been looking around save our lives again.


    Tough if I were partially sighted, or my reflexes weren't honed by years of avoiding other people's accidents.


    And they don't even notice that we had to leap out of the way....
    Or care....
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))
