Car reversing out of park space.

Not even sure if this is the correct place to put this. So was was walking to a bus stop. There was a car coming out of a drive way so I let them go.

I started walking and another car (which I hadn’t seen) started reversing out of the same driveway. It didn’t stop I had to move and it went right into me.

He asked me if I was ok and I said yes, but was it the drivers fault or mine ?

    Driver's fault; they were crossing the footpath.

    Were you on a path? Did the car have to cross the path to hit you? If so, is the cars fault. Did you have earphones on or were you looking at your phone?

    Drivers fault, they should ensure it's clear.

    Always reverse in and drive out.
  • Was on the footpath, didn’t have earphones in or on my phone. I even moved near to the end of the footpath and he still didn’t stop.

    Regardless of being on phone or with earphones on driver is at fault. None of this mitigates his being at fault. It might be argued in court that level of damages might be lessened, but it does not affect the driver's liability one jot. It is his responsibility to check the way is clear, and this is why I always reverse into a parking space despite the sighs of the wife when I do so. Visibility always easier from the front.

    With a second or two's basic observation, either of you could have avoided this very easily.
  • I only saw when he started reversing out, I moved further out his way nearer to the end of the footpath. So he could see and stop but he didn’t stop.

    Not sure what else I could do.

    Look up the drive...? Reversing lights are a very big clue.


    How long does it take you to move a metre either forwards or backwards to get half a car width out of the way?
