... I will just get my standard rate of £251 and I will need to be reassessed for lcwra element so it’s starting a whole new claim right from the start

    Who told you that?

    It's wrong.

Read the link I supplied for confirmation.

I get it abit more now like I will get transferred over and have to wait like a month or so to get my payment of standard rate and the lcwra element and they might send for me another assessment or they might not

You can ask for an advance so that you don’t have to wait 5 weeks but this is effectively a loan which has to be paid back over 12 months by deduction from future payments.

  • Citizens advice told me that hence why I come on here I’v been told different on here and citizens advice have told me something different, citizens advice told me that once I come off esa I will go on universal credit and I will have to be reassessed and for 13 weeks while they reassess me I will only get £251 a month so basically starting the claim process from scratch.

Very disappointing if CItizens Advice have told you that because it is incorrect.

    Information from their website https://www.citizensadvice.org.uk/benefits/universal-credit/claiming/getting-universal-credit-if-youre-sick-or-disabled/

“You already get Employment and Support Allowance (ESA)
You'll automatically have LCWRA if you're in the ESA support group.

If you already have LCW or LCWRA for ESA you don't need to fill in another form or have a medical assessment for Universal Credit. You'll still have LCW or LCWRA on Universal Credit as long as there's no break between your ESA claim and your Universal Credit claim.

The DWP might still say you need another assessment, but you don't. You can challenge your Universal Credit decision if the DWP say you need another assessment.”

  • I got told about an advance payment which has just replaced the budget loan and that’s what is worrying me if I accept a flat and then accept an advance payment knowing I can afford to pay it off when my payments are sorted but what happens if they don’t put me onto the lcwra element and I’m in a big massive mess where I can’t afford stuff as it will be getting paid for the advance payment

As explained you should get the LCWRA element but unfortunately some claims do not go smoothly. Unfortunately we can only offer advice about what should happen.

  • But the way citizens advice are saying it is I’m choosing to go onto it as I need to claim housing benefit so it’s a change in circumstances but if they got Intouch with me and said we need to move you onto universal credit I will just be transferred over onto the system
  • Thank yous so much tho yous have been a bigger help than them

Very disappointing that you got incorrect advice.

They have feedback forms, it may be worth reporting back to them so this error is not repeated with other clients.

Both of these statements are true.

If you wish help with rent that is a change of circumstances which requires you to claim UC, thereby ending your ESA claim.

If you do not wish help with rent you can stay on ESA but at some future date you will be required to switch to UC because all ESA claims will be closed. However this process will take several years.

In both cases if you are in ESA Support Group immediately before claiming UC you are entitled to the LCWRA element from the start of yourUC claim.
