    The court date is the end of next month. I have noticed it says on the Notice of Allocation form that I must send all evidence to the parking scammers and the court, and that they must do the same no later than 14 days before hearing.This seems a bit strange having to sent all your evidence to the parking company.

    Am I supposed to be paying a fee?
    Is a witness statement really necessary?

    You must send all your evidence to the court and the claimant by the prescribed date.

    You do not need to pay a fee. Read the notice again. It is clear.

    Yes a Witness Statement really is necessary.

    You also need to file and serve a Cost Schedule.

    I got your pm.

    Just to confirm this is at Worthing Court, One Parking Solution using Gladstones, and it's a rubbish case about a PCN issued by CCTV to a driver who stopped for one minute to drop someone off at the little road 'Stoke Abbott Court' off Stoke Abbot Rd? 

    Email me about the case and I can normally turn up to lay rep for locals, and to stop for one minute is well within grace periods in a purported PDT machine site.  

    I looked at it on GSV and it looks like part of the road off Stoke Abbott Rd, and the signs only point one way and there is no entrance sign (well a tiny one at car wheel height, hidden by the first parked car).  It has no appearance of a car park.

    I can confirm this is at Worthing Court and the claimant is One Parking Solution. It was for one minute at Stoke Abbott Court!!!

    I was at Worthing yesterday vs UK Car Park Management. 

    I won quite comfortably thanks to the advice of people on here.

    What I did  notice yesterday is that One Parking Solutions are based in Worthing and 2 of their employees were there to participate so make sure you are properly prepped on all of your points
  • Judge Harvey was on the ball though so I imagine the DJs at Worthing will be well aware of these crooks and their tricks

    Hey there, I saw your thread about Parking in Stoke Abbot Road and wondered if I might be able to ask for some info if that's ok? I'm currently fighting the exact same case as you against One Parking Solution for "parking" outside Sussex Beds almost 3 years ago for 5 minutes when I had no clue it was a pay and display. It's been going on 3 years and whilst I'm confident of beating them in court (if they are silly enough to go that far), I'd be interested to know the details of your result and how it was won if that's ok, since I believe it has set a precedent that I could use in my case against them. Many of the points you raised are very similar to mine but I just wanted to make sure I'm getting it all right.
    I notice the carpark has been shut down now as well, which is a shame! :-)

    There is no "precedent", because county court is too low level for that, formally
    But if there was apersuasive finding of fact in general about that car park, such as signs, then thats a thing you can refer to.

    Stoke Abbott Road in Worthing was an entrapment zone, not a car park!    You need your own thread if you haven't already.

    Don't assume this will be easy to win.  The local Circuit Judge thinks (wrongly) that OPS' shonky signs like those are adequate and that they can add false costs (he didn't realise they were false and never asked what they were actually for, and assumed wrongly...). 

    However, he did say there is a ten minute grace period and no drivers should get a PCN if only at a site less than 10 minutes so that will be the crux of the matter at court for you.
