No I would just reply and repeat the fact this is a predatory scam.

Say that the IPC & Gladstones (being pretty much one and the same and sharing Directors for a long time) should be ashamed of propping up such daylight robbery. It is typical of this industry and the IPC/Gladstones to have the nerve to allege with a stright face, that a driver can be conned out of £100 for stopping for seconds/minutes, yet having had no fair opportunity to learn of the terms on any adequate signage first.

Finish by saying, if they fancy wasting some time and court costs, then you will see them in court, and will claim your own costs on the indemnity basis and will not agree that the matter is 'relatively straightforward' as is legendary in their template letters and will require an oral hearing at YOUR local court.

Obviously change the possessive pronouns to make sense...

Thank you for your reply. One thing I am confused by is IPC. Is it not OPS (One Parking Solution) as they are the parking company?

One Parking Solutions are BPA operators, the BPA being their Accredited Trade Association (ATA). The IPC are the one other ATA in the private parking game and are umbilically attached to Gladstones solicitors who generally pursue court claims on behalf of IPC members.

But where there’s a chance of getting a snout in another trough, they don’t mind taking on BPA members’ cases too - as in yours.

I suspect Coupon-mad saw Gladstones name and automatically assumed this was an IPC case?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    ***UPDATE*** CLAIM FORM RECEIVED

It has been around three months since I have heard from Gladstones via email and I have now received a claim form in the post from One Parking Solution.

In the particulars of claim section it says nothing about the period of time that I was parked (a whole 1 minute), it just states I 'parked in breach of the terms of parking stipulated on the signage'.

I have submitted the acknowledgment of service online. I presume next step is to put together a defence. Is it best to do it in writing or online?

Where can I find some examples of cases that have been won for parking for less than the grace period?
I see lots of examples on the newbie thread but not one like this, and cannot find any when using the search bar.

    Any advice is much appreciated.

I would love to see the judge's face when this comes before him/her. One minute, it takes longer than that to read the sign.

Nine times out of ten these tickets are scams so consider complaining to your MP.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies

Sorry but I do not understand the link. It talks about a false amount of £60. I am asking for advice on a claim form.

Please go HERE and you will see one of the 17 pre-written defences to be found in the NEWBIE sticky post # 2, which talks about grace periods. Use it and adapt it to suit your circumstances.

When you have written your defence from the link provided above, search the forum for Abuse of Process (or use the link provided by The Deep) and add the comments on post # 14 of the thread by beamerguy. This will strengthen your defence when talking about the PPC or its solicitors adding in a false amount of money. If they didn't in your case, then please ignore this bit.
