You may be correct (in a few cases) but I do not agree with your sentiments.
I am 73, been driving for around 56 years, have driven more vehicle types than most people. I keep a close eye on my driving and the moment I consider that I no longer have what it takes to be a competent driver, is the moment I give up my car. The fact is that most 97 year olds will have long ago reached this point: if this incident had involved an 'ordinary' 97 year old citizen and driver, he would have been subject to an inquiry as to his fitness to drive. Does anyone think that will happen in this case? No, didn't think so.
Just as a matter of interest, how old are you? Still driving?I think this job really needs
a much bigger hammer.

Any other 97yo would be being sat down by the police, and the conversation would start with "We think now would be a very good time to consider handing your licence in, and if you agree then no further action will be taken over this incident, SIR..."
But just think about what must have gone through the heads of the people in the other car, when they realised who they'd hit...0 -
