    The BLUE wording seems incredibly aggressive and a very militant approach. From what I have read on this forum it would appear many of you know far more than me about this than I do.


    However how likely is it that:


    A They will not pursue this after declining to pay the PCN? And I add here, im new to this, so it would appear there scare tactics are working.


    B IF it goes the distance then will I ultimately potentially have to pay 00s of £s?


    C I assume one would not have to attend court? Is it all done online? Could my credit rating be affected if it went the distance?

    They are likely to pursue it, but we see 99% wins.

    And you have POPLA to try first, plus a complaint to the landowner which OFTEN reaps a cancellation.

    Nope. £100 PCN plus fifty quid court fees, if you are in the 1% who lose.

    No CCJ even if you lost, as you would have 30 days to pay, and no CCJ remains at all, not even as a smudge.

    But you are worrying about something that the Store manager could kill off this afternoon!

    I understand that I can use the below wording as it is outside the Date of contravention and notice date period? Would you advise to use this perhaps in addition to the BLUE template or even on its own?

    I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    There is no legal requirement to name the driver at the time and I will not be doing so.

    Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

Very lucky, given that Britannia don't normally do this and must have just got held up while their office was closed between Xmas and New Year.

    DO NOT miss your POPLA code though, next month. You need to kill it off as Britannia sue people and you don't need that.

    They have also lawfully?? obtained much information in going through this process with regards to data protection. How does one dispute this? Should one?

    They do not need your consent to get yoru data from teh DVLA, and they are fully entitled to get this data REGARDLESS of meeting the requiremetns of pOFA or not. So no, you cannot do anything about it.

    I received a response to my appeal advising that this is my first PCN! therefore "they are prepared to cancel the notice; with the understanding that you will not continue to breach the term and conditions; as you are now aware of the maximum stay time permitted for this car park"



    There was NO mention of the them being outside of the 14 day time period to issue the PCN (as per my letter above) BUT they did mention about Grace periods for some reason. I did not mention in my appeal about this at all.


    Is there anything else that now needs to be done or is that it??

    Well if that is the case what can I do about that?

    THere is no further question on te appeal
    It has been accepted

    Howver you can inform them that, as they have cancelled the PCN, they no longer have "reasonable cause" to continue to process your data.
    You require they cease processing your data within 21 days or explain why they *Cannot*. In the latter case this must be supported with reference to their permission to process under teh DPA2018 and how their processing is justified.
