    most private companies price there contract with land owner to work out how much they can screw out of customers , in fact VCS pay Peel £250,000 for "fishing rights" , same as many large car parks we read about , , parking eye v sainsburys , big court case PE won on loss of earnings .

    indigo get paid by train owner AS WELL as trying to say they are owed money for breaching bylaws , PAY UP £100 AND WE WILL NOT PROSECUTE YOU (they cant!!!!)

    other bodies can indeed start court action - where you thinking train co?

    but indigo cannot hand info from the DVLA to train Co

    however the customer can give all there details to the prosecution co , masquerading as an appeals , this bypasses KODOE

    yes in this case it was one local counsil that did not follow the rest of the country as in decriminalised , this is out of my field , nut I have read the case

    You seem to be suggesting that Indigo may well have permission to prosecute in a magistrates court.

    If that's the case, I wonder why they haven't bothered.

    Yes I would suggest they probably do.

    If we can persuade Newbies to do nothing then that is the safest option currently. Personally I'm rather risk averse with Newbies. Let's face it most of them don't have a clue. Some seem to have problems spelling their own names.

    Those that must do something will probably have to go to ITAL and will hopefully it will serve as a useful experience for us.

    to my knowledge indigo in any guise (vinci etc) have not initiated a magistrates court claim

    they are quite happy "conning" the public into thinking they can start court action , and are really miffed with the public complaining about bylaws ro the BPA that they pulled the plug for several yrs

    an interesting fact is that "ital" was created from an almost dormant company (INDEPENDENT TRANSPORT ASSOCIATES LIMITED) within weeks of the DFT getting involved

    I don’t think that’s correct. Anyone can prosecute unless the prosecutor is specified in the statute. I can bring a private prosecution if I want to.
