The appeal result is not binding on the motorist, however, if you have an unsuccessful appeal and opt not to make payment, you may face action via the Magistrate Court. You have the option of taking the case to Court yourself as well.

why bother , you can put what you want in an appeal , if you loose , its not binding on you , INDIGO cannot start court action (contract )

    I thought ITAL had said elsewhere the decision WAS binding on the motorist. Now they are saying it isn't?

    I just rang my local court and asked if I could prosecute myself , the men in the white coats are outside now !!


    serious note:

    indigo cannot start court action in there own name (contract)
    however the train companies CAN and do often for things like fare evasion , 100s a week
    by filling in the ITAL appeal form you are giving full name address DOB , etc etc to ital , who also do prosecutions for the train companies .

    why else would an appeal co want that much info (dob)

  • This is what the BPA confirmed to me on Sunday.
    There is no mechanism as far as I am aware of taking this case yourself to the magistrate court

    we have advised people not to ignore PARKING tickets since 2012 , and on pepipoo and even here NEVER NEVER ignore penalty notice from counsil/police

    however the indigo/bylaw cases are different , yes for many yrs indigo simply did not send info to POPLa , and we won .

    ITAL smells like wright hastle /popla (they are appeals NOT solisitors -said the BPA)

    remember we ARE PLAYING MAGISTRATES HERE not county court , so a lot more to loose , and larger costs etc

    why bother with appeals , why not sit back and read a book (shakespere?) for 6 mths

    say nothing and they can do nothing , why invite ITAL group - prosecutions to gain from your data

    people can advise what they want to people when they ask for help , me I am going down the IPC route , dont bother appealing as your failure will be passed to gladrags the day after

    Because Indigo and ITAL seem destined to screw them up (at least at first) like in that pepipoo thread last week, where no evidence was provided & the OP won.

    People can exploit the cluelessness of ITAL who only seem to know about train ticket offences.
