In your original post you said "I knew it wasn't authenthic item but agreed to buy it, anyway" which rather reads as though the auction made it clear that the bag was not authentic.
Not exactly. Soo, i've arelady said that I beleived it was an original item from the way it was described. What I meant by saying "I knew it wasn't authenthic item but agreed to buy it, anyway" is that I had paid before I found out that it wasnt' original, that's why I though it was too late to cancel the bid...

So in other words it was basically being sold as genuine - ie there was not an explicit admission by the seller on the listing that the item may not be genuine....?

No, there wasn't...That's why I thought I'd go for it :-(

    This is the description:

This chic new <...>handbag was given to me by an extremely generous friend for my birthday...although seeing as I have another one very similar I have decided to sell it. My loss is your gain!
    <...>
It comes complete with authentic tag and dustbag, with another spare dustbag should you ever need it.

This bag of extremely high quality and normally retails at about £400, so serious bidders only please. If you win this bag you know you will be getting an instant bargain....

So, going right back to your OP. Are you bothered by the fact that its fake? Or is it just the fact that the zip is broken?

It is fustrating and I do feel sorry for you, but this is the problem with buying off eBay. Its not like buying from a regular shop.

(This is what Martin has stated somewhere on this site)

With private sellers it’s ‘buyer beware’. (Caveat Emptor) Buy goods from private sellers and you’ve only a right that the product is correctly described and the owner has the right to sell it. Here it’s caveat emptor or let the buyer beware. If the buyer says nothing and no description and you buy it – then that’s it – even if it doesn’t do what you thought it may – you were not missold. Normal consumer protection law does not apply to private sales.

EDIT: I have deleted the item number post, however its very easy to find in the completed listings.

    Bargainbabe,
You know the story now and to be honest, in the beginnig I was bothered with the bag being fake but I thought that I'd go for it as I had already paid when I found out and thought there was nothing I could do about it. But then I got really mad when I received it and it was damaged.

I know... I'm gutted - it was an expensive bag and the lady doesn't even admit that she ripped me off...You should have seen that bloody zip...Well, that would teach me to be very careful next time when I buy things off ebay. But a £96 lesson - isn't it too much :-)

    Merci! :hello:

    *Sigh*

Ok, well how about this then. Take it to a CD retailer to get proof that it is definitely fake. On the listing its states its Christian Dior. If it is fake then you could claim you were misdescribed. Not only through Paypal but also through eBay themselves.

By posting the Item number it gives ppl a clearer picture of your situation. In fact now I've seen the listing I think you have a leg to stand on. (providing it is fake of course!)

    Bargainbabe,
Thank you very much for your help.
Do you mean, I should find a shop that sells CD bags and take it there so they'd check it for me?

Dear Bargain Babe, I am having a 'blonde moment' day and you are quite right. I didn't mean to say that I agreed with la_fleur, I actually meant to say that I agreed with paracaine although I am confusing myself now...

You know I have my odd moments BB, I really wouldn't have noticed it so thanks <BG>

Yes. They will be able to confirm the item is fake. Also, after looking at the auction pictures, I noted that the pics where always taken with the zip unzipped. Not proof of anything of course, but dodgy!

Good Luck fleur, I hope it turns out in your favour.
