Hi,
Could anybody please advise on the following:
A few days ago I've purchased a bag on Ebay which cost me £96. I found out that the bag wasnt authentic only after I've made a payment. I couldn't ask her a question as I was bidding at the very last minute. As I'm new to Ebay I thought it was impossible to cancel the bid. So, I've made a payment prompty and was waiting for the bag to arrive. So, this morning I've received it and to my disappointment I found out that the zip didn't work properly. So, immediately I've contacted the seller and the lady claims that it all worked properly when she was sending it. We have exchanged a few emails in which she mentioned that she's not obliged to give me any refund and advised me to leave any feedback I liked, even a negative one. So I did. What do I do next? I paid by PayPal. Do I have a good chance to get a refund? Many thanks.

It's incumbent on the seller to get the goods to you in the condition advertised- if she sent it out working and it got damaged in the post that's her problem, not yours. If she still refuses to give you a refund and you paid by PayPal you should be able to initiate a chargeback- though email the seller first telling her that you will be doing this- it causes the seller grief and she may cave in rather than go through that.0

The thing is that girl clrearly doesn't beleive me therefore she refuses to pay me back. I'm frustraded, really. It was my first big purchase on Ebay and now I'm not sure if I ever be tempted to do it again. I've left a negative feedback although now I'm regretting it as think that now she might refuse to pay me back. But how can I prove that it was damaged when I recieved it?! It's her word against mine...
And please tell me, what is a chargeback? Is it the same as refund?0 -

Not sure how this works but e-bay has something called Square Trader(?) I think that's the name, anyhow they work as go between for both of you, I am sure it's free it may be worth looking into.
If it was damaged in the post they why can't she claim against the post office?0 -
i had to do a chargeback as i had an item not recieved from the u.s
the seller was not responding to my e-mails and wouldnt trace the package for me after 6 weeks.
so i done a chargeback.
i got my money back!

I'll bow to superior knowledge if I'm wrong, but this isn't how I understood it. I had an issue a while back and the line I got from ebay was something like:-
"As long as the good were in the condition described when posted and proof of posting and any insurance bought were obtained then your responsibilites have been met"
If this isn't the case why would a buyer pay extra for insurance on postage? (IE if it arrives buggered or never arrives at all, the seller would then still have to refund you).
La_fleur, did you pay extra for insurance or is the item value under £30?
If so then the seller should be able to apply to the royal mail (if it came from this country) for the cost of the item and postage (up to £30 on standard mail)
That said the sellers attitude doesn't sound good, so maybe the chargeback is the best way to go?

No, I didn't pay anything for insurance...The item cost me £90 + £6 postage cost. Anyway, I'm still hoping to get my money back. I've contacted my bank, they told me if I won't be able to get any help from ebay, then they will get involved. Also, the item was not authentic and the seller didn't menitoned it in the description. And I only realized it after I won the item. £90 for a fake bag? Sounds like a rip off to me anyway...0
