    I'm annoyed popla didn't mention the issues with the contract or the lease.

    Is it just a waiting game now? Won't they be emboldened by their 'win' and put a claim in anyway?

    OPS are not especially litigious, nor are they clever enough to be 'emboldened'.

    We only see a few cases from them and we maintain our 99% win rate. :)

    Sorry, C-M, I've used the word "rebuttal" before when attempting to advise someone else when they got the evidence pack for their appeal - consider my wrists slapped with the heaviest object I can find :(

    Hi all, my mother has received what looks like a Letter Before Claim from One Parking Solution for this ticket. I have read the newbies thread and found a suitable response, but wanted to make sure this was a genuine LBC.
    The debt relates to a parking charge (detailed above) for which you are liable. Full details of the charge have previously been provided to you within the Parking Charge Notice and/or Notice to Driver/Keeper that have been served upon you. The claimant will rely on these documents in the forthcoming action against you.

    We refer you to the Practice Direction for Pre-Action Conduct under the Civil Procedure Rules and in particular paragraph 4 of the same which concerns the courts powers to impose sanctions for any failure to comply.

    Unless a satisfactory response is provided within 14 days from the date of which this letter was sent, we may start proceedings against you without any further notice in order to recover the amount due and any associated costs that are involved with the recovery of the debt. The amount that is claimed may therefore increase in terms of costs and any interest that is recoverable.

    LBCs should give 30 days to respond and should include financial forms (which you don't fill in) and contain full POC with all the evidence they intend to rely on. Check out NEWBIE post # 2 for full details of LBCs

    as mentioned in the last post , although they mention the PaP, they have not complied , due to 14 days instead of 30 days and no financial forms included


    I would IGNORE it and wait for a compliant LoC and/or an MCOL from the CCBC in Northampton to come in the post

    Hi. Need help please. My nephew took the car from me 1/04 as he was doing some loading, due to moving out of the country.He lived in the flats next to Vantage Point(Brighton).He used the car park by Vantage Point cause it was easy access to his flat. He left the country on 2/04 for good.Back to Poland. Seriously! i received NTK from OPS 9/04. Picture shows my car was at he car park for 31 min and 5 sec.I appealed(never said who was driving) but it was rejected on 1/05. they gave me POPLA code and now i have not much days left ,so i have to do it fast, but not sure how to start.On the rejection letter they were saying ;( This appeal has been considered in conjunction with the evidence gathered by the
    parking attendant at the time of the event) My nephew said there was never a parking attendant and he was within the car all the time, as he packed lots of things to the car. Any help what to write to POPLA , I will be very grateful PLEASE!!!!

    Read the sticky thread for NEWIES then start your own thread if you need further help. This thread is only for helping the original poster so you need your own thread to get bespoke help.

    The easiest option for you is to give the name and (overseas) address for service of the driver to the scammers, and get the driver to confirm this if/when the PPC contact them. No appeals needed except you will be costing the scammers money.

    You have 32 days to do a POPLA appeal, counting from the rejection letter.
