    27 days the policy has been cancelled for, no missed payments or arrears only money owed to myself.

    Get onto Action Fraud or your local plod ASAP.
  • What's the big deal? They've messed up and are putting it right as well as making a gesture to back their apology. What loss have you/will you suffer as a result? Have you incurred overdraft charges or similar?

    Honestly, just let them put it right and shop elsewhere in future.

    My biggest gripe is that they barefaced lied to me about not having my card details to issue me money owed. Instead opting to send a cheque, which today I was told hadn't been processed, even though on two other occasions I had been told it had.

    Then 27 days later decide to take money out of my account for no reason what so ever, without an explanation.

    I have to say if none of that would bother you, then I envy you.

    Aren't the meant to refund you by the same method you paid?

    I am with the OP on this. A Direct Debit is easier for the customer as firstly they can cancel it with their bank and secondly the bank are responsible for making refunds for errors. If the insurance company take it by card, there is no such protection or rights, hence why companies prefer to have a card mandate rather than a Direct Debit.

    Also taking a payment via card without the authorisation of the card holder is by definition fraud. By processing it they are declaring that the customer has authorised the transaction, which in this instance the customer hasn't done. Now the intent may not have been to defraud, but it is improper use of the card details and using without cardholder authorisation is fraudulent whether by intent or not.

    You can't accidentally commit fraud.

    How did you make you're first payment to Hastings? When I have taken out online insurance the first payment is by card and the rest spread out over direct debit.

    I recently had a partial refund for a holiday paid for with my debit card. The only options to repay me were by cheque or a bank transfer even if I gave them the card details.
