Hi There,
Today I have had a letter from BW Legal asking me to pay a parking charge from 2015 - Britannia parking in Stafford.
I was the registered keeper of the vehicle however my wife was driving at the time.
My wife actually purchased a ticket from the machine but Britannia stated otherwise (other people in Stafford have had the same issue)
We have ignored all letters so far over the years but now I’m being given 28 days to respond before they proceed to the CC.
Just in the process of taking the first steps in my defence as advised on here so will let you all know how I get on .
Colin

Unless you've had a formal MCOL claim via the Northampton CCBC, there's no need for a defence at this stage - just so you know.
That's not to say that some advance research and planning won't pay dividends, but you're a little way off having to produce a defence. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi Again,
BW Legal have now got hold of my personal and work mobile number and are calling and texting me everyday.
Surely this can’t be right with all the GDPR guidelines put in place this year ?0 -

"Pls remove the phone number we hold on file
Thank you
Sent from Samsung Mobile on O2"
The reply was sent to me with no-one else Cc'd. I think they had meant to forward the email and not reply to just me directly. Just shows how hilariously incompetent and careless BW Legal are. See beamerguy's thread 'BWLegal - the list of failures growing and the FAKE £60 add-on' for further examples of their failings (would provide a link but can't do so as a newbie).
Nevertheless, they have continued to harrass me on my phone. Whether they ignored my request or mishandled it - I don't know. But I have evidence of my request and I do know they store a log of phone calls (but have been known to reportedly remove some calls to look innocent) so I am fuelled to send a SAR for their calls log and then use the evidence to complain to the SRA (Solicitors Regulation Authority). Then I can complain to the ICO for nuisance calls and spam texts. I'd suggest you do the same if you want them to make them stop. Take action. I know I will.0 -

Then do as said here.

I urge you to report this grubby law firm to their regulatory body, the SRA.

as I am sure they do not condone this conduct. Also complain to your MP.
It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers. You never know how far you can go until you go too far.0 -
Help! I too have had a letter from Britannia and be from June 2017. I no longer own car as was destroyed by fire and signed over to insurance co. They have left message on answer phone and called my home today. I parked on pub car park but didn't pay ticket as was going to restaurant at bottom of car park I have parked there before so thought it was ok. They are threatening ccg and cost up to 247. Do I continue to ignore?0

Do I continue to ignore?
You shouldn't be posting on someone else's thread, so please, after first reading the NEWBIES FAQ sticky, post #2 which covers the court process, start a new thread of your own for further help. Please note, we are not a legal advice forum.
