    Lots of guidance on how to write a Defence in post #2 of the NEWBIES thread, together with many examples.

    Look for Bargepole's concise defences and start from there.

    So BWLegal has issued a court claim and their client Britannia so far has not responded to a SAR.

    Don't BWLegal know what's going on ??? SEEMS NOT

    This is total incompetence and as such, the SRA must be advised of such incompetence that you are waiting for information from their client to assist your defence but BWLegal proceed with a claim

    What can you say to a judge .. "sorry Sir but the claimant has not provided the information requested"
  • Ok, I have read through a few letters but I’m unsure which one fits to my scenario , facts below.

    Claim is against me as registered keeper , my wife was driving with our kids present , it was a machine where you put your reg in and paid , the ticket seemingly was from a camera.

    My wife used to park here regular , she’s adamant that she would have purchased a ticket , however by the time the pcn came through the ticket would have been binned - who keeps parking tickets ?

    Can you advise on best template please ?

    Look for one that talks about the PCN being non-POFA and the fact the keeper was not driving. Pretty sure at least one the the templates must have that wording as it's hardly something new!

    Please find enclosed your SAR request.

    Britannia Parking have amended their processes in line with current BPA guidelines, furthermore on review of the Parking Charge Notice I can confirm we have decided to no longer continue with our legal case.

    We have instructed BW Legal to close the claim.

    Britannia realises it has behaved badly and also realise that we tried to scam you. The charge notice is cancelled, so sorry

    We have informed BWLegal to cease as it would be another timewastng exercise for the courts.

    We will waive the extra £60 as this was an attempt by BWLegal to
    circumvent the Small Claims costs rules using double recovery

    Aha, so that tells us there was a one digit typo in the VRN, and Britannia didn't want to show you that in the SAR.

    But they HAVE TO reply to your SAR anyway, so insist on seeing the data!

    They can't just deny you the photos and documents. INSIST and if they ask for £10, or do not reply with the SAR data, report them to the ICO (online, very easy to do).

    Don't worry, they can't change their minds, a discontinued claim is a dead dodo.

  • Coupon you are 100% correct , they sent me the SAR and as you rightly say there was 1 digit wrong on the VRN that my wife entered into the parking machine , they sent me the evidence.

    Thankyou all so much for your help , without it I would have been doomed by these cowboys.

    Can I complain for wasting my time and too who ?
