    Dear Forum members ,
    The DQ will be sent back today.
    The Defendant named on the Claim Form is the person wo must Defend the Claim.
    Of course you can do all the work beforehand, but everything must be done in the Defendant's name.
    At any court hearing the Defendant must attend, but you can speak on the defendant's behalf. It is possible that the Defendant will be asked direct questions which of course must be answered.

    I don't think so. You just inform the court on arrival and discuss with the Judge as the first point in the hearing. You must take along the relevant document (I can't recall the name - something from the Law Gazette?) which outlines the rights of a Lay Rep. Just do a forum search on Lay Rep, and the name will be there somewhere.

    You do need that with - only last week we had a thread where the LR was denied audience by the Judge - erroneously it seems, but without the paper to prove the point, the LR had to give way.

    Is it okay to write TBC for now ? This is what the claimant has said in their DQ copy that they sent .

    The main WS comes from the defendant - why would you want to 'hide' the defendant's name behind TBC?

    Sorry Umkomaas;reading my post again-it is indeed confusing.


    The question on the DQform is
    D3 ' How many witnesses ,including yourself,will give evidence on your behalf at the hearing?

    What I meant to ask was: in addition to the defendant, if there were to be ONE other witness , does it have to be specified on the form as 2 ( as it is yet to be decided whether the defendant will take the witness along or not) or can it be left as TBC ?

    The Claimants DQ has left it as TBC...

    On that basis, I guess (I am not a lawyer) yes. Presumably it is a Witness who will write a WS and contribute to the hearing if asked by the Judge (as opposed to someone attending with the defendant to offer moral support)?

    Thanks Umkomaas.Yes,if the defendant decides to take along another witness, there will the WS from the witness too.
    Not clear if you said yes to 2 or to TBC?
